DEFINIZIONI<\/h2><p>Ai fini delle presenti Condizioni:<\/p><dl><dt><strong>Piano <\/strong>indica il piano funerario prepagato acquistato presso Elysium.<\/dt><dt><strong>Titolare del piano <\/strong>Indica la persona indicata nel Piano.<\/dt><dt><strong>Documentazione del piano <\/strong>Indica la documentazione individuale rilasciata al Titolare del Piano che conferma il Piano selezionato, il prezzo, le modalit\u00e0 di pagamento e le prestazioni applicabili.<\/dt><dt><strong>Parente pi\u00f9 prossimo <\/strong>Indica la persona legalmente autorizzata o comunque riconosciuta da Elysium per comunicare con noi in merito alle disposizioni successive al decesso del Titolare del Piano.<\/dt><dt><strong>Impresario funebre <\/strong>Indica un operatore funebre designato da Elysium o un fornitore locale autorizzato di servizi funebri.<\/dt><dt><strong>Costo del piano <\/strong>Indica il prezzo totale indicato nella Documentazione del Piano.<\/dt><dt><strong>Collezione Privilege <\/strong>Indica i vantaggi aggiuntivi applicabili ai Piani idonei in base al tipo di Piano e alla modalit\u00e0 di pagamento.<\/dt><\/dl><\/section><p><!-- 4. Our Funeral Plans --><\/p><section class=\"terms-section\"><h2>4. I NOSTRI PIANI FUNEBRI<\/h2><p>I principali piani di Elysium sono:<\/p><div class=\"terms-subsection\"><h3>4.1 ELYSIUM ASSIST<\/h3><p>Un\u2019opzione di cremazione diretta riservata specificatamente ai nuovi clienti idonei di et\u00e0 pari o superiore a 75 anni, subordinatamente al rispetto dei requisiti di idoneit\u00e0 applicabili.<\/p><p>Il costo di Elysium Assist deve essere pagato per intero.<\/p><\/div><div class=\"terms-subsection\"><h3>4.2 CHIAREZZA<\/h3><p>Un piano di cremazione diretta senza partecipanti al lutto n\u00e9 cerimonia funebre religiosa o umanista.<\/p><\/div><div class=\"terms-subsection\"><h3>4.3 TRANQUILLIT\u00c0<\/h3><p>Un piano funerario tradizionale che comprende la sepoltura o la cremazione e l\u2019organizzazione per i partecipanti al funerale, senza una cerimonia funebre religiosa o umanista.<\/p><\/div><div class=\"terms-subsection\"><h3>4.4 SERENIT\u00c0<\/h3><p>Un pacchetto funerario tradizionale che comprende la sepoltura o la cremazione, i partecipanti al funerale e una cerimonia funebre di carattere religioso o umanista.<\/p><\/div><div class=\"terms-subsection\"><h3>4.5 UNIT\u00c0<\/h3><p>Un piano di rimpatrio che prevede servizi di rimpatrio specifici dalla Spagna, dal Portogallo o da Cipro verso un paese di destinazione idoneo, in conformit\u00e0 con la documentazione specifica del piano e alla normativa vigente.<\/p><\/div><div class=\"terms-subsection\"><h3>4.6 PIANO ABITATIVO<\/h3><p>Un piano che prevede una celebrazione della vita condotta da un celebrante di Elysium prima del decesso del titolare del piano.<\/p><p>Le disposizioni relative al funerale in caso di decesso continuano ad essere regolate dal piano funerario di riferimento.<\/p><\/div><\/section><p><!-- 5. Elysium Assist --><\/p><section class=\"terms-section\"><h2>5. ELYSIUM ASSIST \u2014 OVER 75<\/h2><div class=\"terms-subsection\"><h3>5.1 REQUISITI DI AMMISSIBILIT\u00c0<\/h3><p>Il programma Elysium Assist \u00e8 disponibile per i nuovi clienti di et\u00e0 pari o superiore a 75 anni che, al momento dell'acquisto, soddisfino i requisiti di idoneit\u00e0 previsti da Elysium.<\/p><p>I titolari di un piano Elysium gi\u00e0 in essere non possono passare a un piano di livello inferiore, ovvero a Elysium Assist.<\/p><\/div><div class=\"terms-subsection\"><h3>5.2 PAGAMENTO<\/h3><p>Elysium Assist \u00e8 disponibile solo previo pagamento dell'intero importo.<\/p><p>Non \u00e8 disponibile con pagamento mensile o a rate.<\/p><\/div><div class=\"terms-subsection\"><h3>5.3 PREZZO<\/h3><p>Il prezzo attualmente pubblicizzato per Elysium Assist \u00e8 <strong>\u20ac1,800<\/strong>.<\/p><p>Il prezzo applicabile sar\u00e0 confermato nella documentazione relativa al singolo piano.<\/p><\/div><div class=\"terms-subsection\"><h3>5.4 DISPOSIZIONI FUNEBRI<\/h3><p>Elysium Assist offre un servizio semplice e diretto per la cremazione diretta.<\/p><p>Sono inclusi solo i beni e i servizi espressamente indicati nella documentazione del Piano Elysium Assist.<\/p><p>Tutto ci\u00f2 che non \u00e8 espressamente incluso \u00e8 escluso, salvo successivo accordo scritto.<\/p><\/div><div class=\"terms-subsection\"><h3>5.5 DIVIETO DI RACCOLTA DI DATI RISERVATI<\/h3><p><strong>Elysium Assist non rientra in nessuna delle collezioni Elysium Privilege.<\/strong><\/p><p>Ci\u00f2 comprende, salvo diversamente concordato in modo esplicito:<\/p><ul><li>Libero arbitrio;<\/li><li>donazione di beneficenza;<\/li><li>piantumazione di alberi;<\/li><li>Impegni di rimborso;<\/li><li>Vantaggi del trasferimento in entrata;<\/li><li>12 sorteggi fortunati; e<\/li><li>altri vantaggi promozionali.<\/li><\/ul><\/div><div class=\"terms-subsection\"><h3>5.6 AGGIORNAMENTO<\/h3><p>Un piano Elysium Assist pu\u00f2 essere convertito in un altro piano funerario Elysium disponibile in qualsiasi momento.<\/p><p>L'aggiornamento sar\u00e0 soggetto alle seguenti condizioni:<\/p><ul><li>il Piano selezionato;<\/li><li>il prezzo in vigore al momento dell\u2019aggiornamento;<\/li><li>i Termini e condizioni pertinenti; e<\/li><li>eventuali pagamenti aggiuntivi dovuti.<\/li><\/ul><\/div><div class=\"terms-subsection\"><h3>5.7 OFFERTE<\/h3><p>Elysium Assist non \u00e8 cumulabile con altre offerte, promozioni o sconti Elysium, salvo espressa autorizzazione scritta.<\/p><\/div><div class=\"terms-subsection\"><h3>5.8 TRASFERIMENTO IN ENTRATA<\/h3><p>Qualora Elysium Assist venga utilizzato nell\u2019ambito di un accordo di trasferimento, le spese di annullamento, amministrative o di altro tipo applicate da un altro fornitore di piani funebri non saranno rimborsate, salvo espressa intesa scritta.<\/p><\/div><div class=\"terms-subsection\"><h3>5.9 REQUISITI LOCALI<\/h3><p>L'organizzazione del funerale sar\u00e0 affidata a un fornitore di servizi locale autorizzato e adeguato, e rester\u00e0 soggetta alla disponibilit\u00e0 locale, ai requisiti operativi e alla normativa vigente.<\/p><\/div><\/section><p><!-- 6. Clarity --><\/p><section class=\"terms-section\"><h2>6. PIANO DI TRASPARENZA<\/h2><div class=\"terms-subsection\"><h3>6.1 INCLUSO<\/h3><p>Fatte salve la disponibilit\u00e0 locale e la normativa vigente, il Piano Clarity comprende:<\/p><ol><li>Cremazione senza presenza dei familiari presso un crematorio designato.<\/li><li>Tariffa per la cremazione.<\/li><li>Elysium-appointed Funeral Director services required to arrange the cremation.<\/li><li>Collection and transportation of the deceased from a residence, care home, hospital or approved resting place to the appointed facility.<\/li><li>Care and preparation of the deceased, including hygienic preparation and pacemaker removal where required or permitted.<\/li><li>Simple coffin suitable for cremation.<\/li><li>Simple urn.<\/li><li>Return of ashes to the family in the relevant country, subject to local arrangements.<\/li><li>24-hour bereavement line with English-speaking operators.<\/li><li>Relevant death-certification documentation.<\/li><li>Cremation documentation required for lawful transportation of ashes, where applicable.<\/li><li>Applicable Privilege Collection where the Plan qualifies.<\/li><\/ol><\/div><div class=\"terms-subsection\"><h3>6.2 EXCLUSIONS<\/h3><p>Unless expressly included in the Plan Documentation, Clarity does not include:<\/p><ul><li>Funeral Directors not appointed by Elysium;<\/li><li>face-to-face Funeral Director appointments;<\/li><li>viewing of the deceased;<\/li><li>dressing the deceased in personal clothing;<\/li><li>personal items placed within the coffin;<\/li><li>family attendance at the crematorium;<\/li><li>funeral ceremonies or services;<\/li><li>church, religious or humanist services;<\/li><li>additional mortuary storage;<\/li><li>choice of cremation date, time or location;<\/li><li>wakes or catering;<\/li><li>obituary notices;<\/li><li>flowers or floral tributes;<\/li><li>interment of ashes;<\/li><li>headstones, plaques or memorials;<\/li><li>repatriation;<\/li><li>transfers not expressly included;<\/li><li>audio-visual equipment;<\/li><li>family or guest travel costs; or<\/li><li>goods or services not expressly included.<\/li><\/ul><\/div><\/section><p><!-- 7. Tranquility --><\/p><section class=\"terms-section\"><h2>7. TRANQUILITY PLAN<\/h2><div class=\"terms-subsection\"><h3>7.1 INCLUDED<\/h3><p>Subject to local availability and applicable law, Tranquility includes:<\/p><ol><li>Elysium-appointed Funeral Director services.<\/li><li>Advice concerning death certification and registration.<\/li><li>Cremation fee where cremation is selected.<\/li><li>Collection and transportation of the deceased.<\/li><li>Care and preparation of the deceased.<\/li><li>Simple wood-effect coffin suitable for burial or cremation.<\/li><li>Up to four days\u2019 mortuary or Chapel of Rest provision, subject to local facility arrangements.<\/li><li>One day of viewing for family and friends, subject to local facility arrangements.<\/li><li>Transportation to the appointed cemetery or crematorium.<\/li><li>Relevant death-certification documentation.<\/li><li>24-hour bereavement line with English-speaking operators.<\/li><li>Simple urn where cremation is selected.<\/li><li>Cremation documentation where applicable.<\/li><li>Applicable Privilege Collection where the Plan qualifies.<\/li><\/ol><\/div><div class=\"terms-subsection\"><h3>7.2 EXCLUSIONS<\/h3><p>Unless expressly included, Tranquility does not include:<\/p><ul><li>Funeral Directors not appointed by Elysium;<\/li><li>religious, humanist or other ceremony costs;<\/li><li>additional venue costs;<\/li><li>church or religious venue costs beyond the agreed provision;<\/li><li>wakes or catering;<\/li><li>obituary notices;<\/li><li>additional flowers;<\/li><li>burial plot or grave purchase;<\/li><li>headstone or memorial;<\/li><li>memorial maintenance;<\/li><li>guest transportation;<\/li><li>additional printed materials;<\/li><li>audio-visual equipment;<\/li><li>interment or distribution of ashes;<\/li><li>repatriation;<\/li><li>transfers not expressly included; or<\/li><li>any other goods or services not expressly included.<\/li><\/ul><\/div><\/section><p><!-- 8. Serenity --><\/p><section class=\"terms-section\"><h2>8. SERENITY PLAN<\/h2><div class=\"terms-subsection\"><h3>8.1 INCLUDED<\/h3><p>Subject to local availability and applicable law, Serenity includes:<\/p><ol><li>Elysium-appointed Funeral Director services.<\/li><li>Advice concerning death certification and registration.<\/li><li>Collection and transportation of the deceased.<\/li><li>Care and preparation of the deceased.<\/li><li>Quality veneered coffin suitable for burial or cremation.<\/li><li>Minister or Celebrant for the funeral service, where applicable.<\/li><li>Funeral staff required to conduct the service.<\/li><li>Cremation fee where cremation is selected.<\/li><li>Up to five days\u2019 mortuary or Chapel of Rest provision, subject to local facility arrangements.<\/li><li>One day of viewing for family and friends, subject to local facility arrangements.<\/li><li>Transportation to the appointed cemetery or crematorium.<\/li><li>Relevant death-certification documentation.<\/li><li>24-hour bereavement line with English-speaking operators.<\/li><li>Small floral spray.<\/li><li>Simple urn where cremation is selected.<\/li><li>Cremation documentation where applicable.<\/li><li>Applicable Privilege Collection where the Plan qualifies.<\/li><\/ol><\/div><div class=\"terms-subsection\"><h3>8.2 EXCLUSIONS<\/h3><p>Unless expressly included, Serenity does not include:<\/p><ul><li>Funeral Directors not appointed by Elysium;<\/li><li>additional venue costs;<\/li><li>church or religious venue costs beyond the agreed provision;<\/li><li>wakes or catering;<\/li><li>obituary notices;<\/li><li>additional flowers;<\/li><li>burial plot;<\/li><li>headstone or memorial;<\/li><li>memorial maintenance;<\/li><li>transportation of funeral guests;<\/li><li>additional printed materials;<\/li><li>audio-visual equipment;<\/li><li>interment or distribution of ashes;<\/li><li>repatriation;<\/li><li>transfers not expressly included; or<\/li><li>any other goods or services not expressly included.<\/li><\/ul><\/div><\/section><p><!-- 9. Unity --><\/p><section class=\"terms-section\"><h2>9. UNITY REPATRIATION PLAN<\/h2><div class=\"terms-subsection\"><h3>9.1 PURPOSE<\/h3><p>The Unity Plan provides specified repatriation services from Spain, Portugal or Cyprus to an eligible receiving country.<\/p><p>The receiving country and scope of repatriation will be confirmed in the individual Plan Documentation.<\/p><\/div><div class=\"terms-subsection\"><h3>9.2 INCLUDED<\/h3><p>Subject to the individual Plan, local availability and applicable law, Unity may include:<\/p><ol><li>Legal and administrative formalities.<\/li><li>Liaison with relevant authorities.<\/li><li>Elysium-appointed Funeral Director in the originating country.<\/li><li>Elysium-appointed Funeral Director in the receiving country.<\/li><li>Collection and transportation of the deceased.<\/li><li>Care and preparation for transportation.<\/li><li>Specified mortuary provision.<\/li><li>Coffin suitable for transportation.<\/li><li>Transportation to the airport.<\/li><li>Flight for the deceased.<\/li><li>Receipt by the appointed Funeral Director in the receiving country.<\/li><li>Relevant certification and registration assistance.<\/li><li>24-hour bereavement line with English-speaking operators.<\/li><\/ol><p>If the Next of Kin chooses a Funeral Director other than the Elysium-appointed Funeral Director in the receiving country, any contribution specified in the Plan may become void.<\/p><p>Where a contribution is available, it is limited to the amount stated in the Plan Documentation.<\/p><\/div><div class=\"terms-subsection\"><h3>9.3 EXCLUSIONS<\/h3><p>Unless expressly included, Unity does not include:<\/p><ul><li>Funeral Directors not appointed by Elysium;<\/li><li>additional venue costs;<\/li><li>wakes or catering;<\/li><li>obituary notices;<\/li><li>flowers;<\/li><li>burial plots;<\/li><li>headstones or memorials;<\/li><li>guest transportation;<\/li><li>additional printed materials;<\/li><li>audio-visual equipment;<\/li><li>additional airport or handling charges;<\/li><li>exceptional airline, governmental or authority charges; or<\/li><li>any other goods or services not expressly included.<\/li><\/ul><\/div><\/section><p><!-- 10. Non-Resident Plan --><\/p><section class=\"terms-section\"><h2>10. ELYSIUM NON-RESIDENT PLAN<\/h2><div class=\"terms-subsection\"><h3>10.1 PURPOSE<\/h3><p>The Elysium Non-Resident Plan is designed for individuals who are not resident in Spain, Portugal or Cyprus, but who own property, spend time in or regularly visit one or more of these countries.<\/p><p>The Plan allows the Plan Holder to secure an agreed funeral-plan price while retaining flexibility should they ultimately die outside the covered countries.<\/p><\/div><div class=\"terms-subsection\"><h3>10.2 \u20ac500 DEPOSIT<\/h3><p>A <strong>\u20ac500 deposit<\/strong> is payable to secure the agreed Plan price.<\/p><p>The agreed price will be confirmed in the individual Plan Documentation.<\/p><\/div><div class=\"terms-subsection\"><h3>10.3 DEATH IN SPAIN, PORTUGAL OR CYPRUS<\/h3><p>If the Plan Holder dies in Spain, Portugal or Cyprus, Elysium will arrange the funeral in accordance with the selected Plan and applicable Plan Documentation.<\/p><\/div><div class=\"terms-subsection\"><h3>10.4 DEATH OUTSIDE THE COVERED COUNTRIES<\/h3><p>If the Plan Holder dies outside Spain, Portugal or Cyprus, the Non-Resident Plan does not provide for Elysium to arrange or pay for a funeral in that country.<\/p><p>Subject to the conditions of the Plan, the \u20ac500 deposit will be returned to the Next of Kin less a <strong>\u20ac100 administration fee<\/strong>.<\/p><p>The amount refundable will therefore be <strong>\u20ac400<\/strong>.<\/p><\/div><div class=\"terms-subsection\"><h3>10.5 ADMINISTRATION FEE<\/h3><p>The \u20ac100 administration fee covers administration associated with closing the Non-Resident Plan and processing the applicable refund.<\/p><p>The administration fee is non-refundable.<\/p><\/div><div class=\"terms-subsection\"><h3>10.6 FUNERAL OUTSIDE THE COVERED COUNTRIES<\/h3><p>Elysium does not arrange, manage, fund or accept responsibility for funeral services taking place outside Spain, Portugal or Cyprus under the Non-Resident Plan.<\/p><p>The Next of Kin or family is responsible for making any funeral arrangements in the country where the death occurs.<\/p><\/div><div class=\"terms-subsection\"><h3>10.7 NO PRIVILEGE COLLECTION<\/h3><p><strong>The Elysium Non-Resident Plan does not qualify for any Elysium Privilege Collection.<\/strong><\/p><p>Ci\u00f2 comprende, salvo diversamente concordato in modo esplicito:<\/p><ul><li>Libero arbitrio;<\/li><li>charitable donations;<\/li><li>piantumazione di alberi;<\/li><li>Impegni di rimborso;<\/li><li>Vantaggi del trasferimento in entrata;<\/li><li>12 sorteggi fortunati; e<\/li><li>altri vantaggi promozionali.<\/li><\/ul><\/div><div class=\"terms-subsection\"><h3>10.8 TRANSFER-IN<\/h3><p>The Non-Resident Plan does not include reimbursement of cancellation, administration or other charges imposed by another funeral-plan provider unless expressly agreed in writing.<\/p><\/div><div class=\"terms-subsection\"><h3>10.9 CHANGE OF RESIDENCY<\/h3><p>The Plan Holder should notify Elysium if they become resident in Spain, Portugal or Cyprus.<\/p><p>Elysium may review the Plan and confirm whether an alternative Plan is more appropriate.<\/p><\/div><\/section><p><!-- 11. Family Plan --><\/p><section class=\"terms-section\"><h2>11. FAMILY PLAN<\/h2><p>A Family Plan provides funeral-plan arrangements for eligible members of the same family.<\/p><p>The qualifying Founder Plans must be purchased in full unless otherwise stated in the Family Plan Documentation.<\/p><p>Additional eligible family members may be added subject to the applicable Family Plan terms and pricing.<\/p><\/section><p><!-- 12. Children's Plan --><\/p><section class=\"terms-section\"><h2>12. CHILDREN\u2019S PLAN<\/h2><p>Elysium may provide one free Children\u2019s Clarity Plan for an eligible child under 18 for each qualifying full-paying adult Plan.<\/p><p>The Children\u2019s Plan:<\/p><ul><li>is a Clarity Direct Cremation Plan;<\/li><li>has no Privilege Collection;<\/li><li>is subject to eligibility requirements;<\/li><li>ends automatically when the child reaches 18;<\/li><li>cannot be transferred.<\/li><\/ul><p>Eligible relationships may include children, stepchildren, grandchildren and step-grandchildren.<\/p><p>Evidence of the relationship may be required.<\/p><p>The qualifying adult Plan must remain active.<\/p><p>If the qualifying adult Plan is cancelled or called upon, the Children\u2019s Plan will cease.<\/p><p>Where available, the Children\u2019s Plan may be upgraded to Tranquility or Serenity by paying the applicable difference.<\/p><p>An upgraded Children\u2019s Plan does not automatically qualify for Privileges.<\/p><\/section><p><!-- 13. Living Plan --><\/p><section class=\"terms-section\"><h2>13. LIVING PLAN<\/h2><p>A Living Plan incorporates an Elysium Celebrant-led Celebration of Life before the Plan Holder\u2019s death.<\/p><p>The Celebration of Life may take place over a day or weekend as agreed with the Plan Holder and Celebrant.<\/p><p>The funeral provision following death remains governed by the underlying Elysium Funeral Plan.<\/p><p>Additional Celebrant terms may apply.<\/p><\/section><p><!-- 14. Privilege Collections --><\/p><section class=\"terms-section\"><h2>14. PRIVILEGE COLLECTIONS<\/h2><p>Privilege Collections apply only to Plans expressly identified as eligible.<\/p><div class=\"terms-subsection\"><h3>14.1 PREMIER PRIVILEGES \u2014 FULL PAYERS<\/h3><p>Eligible full-paying Plans may receive:<\/p><ul><li>21-Day Consideration Period;<\/li><li>14-Year Refund Commitment;<\/li><li>10-Year Legacy Refund Commitment;<\/li><li>Free Children\u2019s Plan;<\/li><li>Free Standard Will;<\/li><li>\u20ac40 charitable donation;<\/li><li>piantumazione di alberi;<\/li><li>anniversary tree planting where applicable;<\/li><li>Transfer-In Refund eligibility;<\/li><li>12 Draws of Good Luck eligibility; and<\/li><li>eligibility for Joint or Family Plans.<\/li><\/ul><p>Elysium Assist and the Non-Resident Plan are excluded from Privilege Collections.<\/p><\/div><div class=\"terms-subsection\"><h3>14.2 CLASSIC PRIVILEGES \u2014 UP TO 60 MONTHS<\/h3><p>Eligible monthly Plans paid over up to 60 months may receive:<\/p><ul><li>21-Day Consideration Period;<\/li><li>14-Year Refund Commitment;<\/li><li>\u20ac20 charitable donation;<\/li><li>tree planting; and<\/li><li>eligibility for the 12 Draws of Good Luck once fully paid.<\/li><\/ul><\/div><div class=\"terms-subsection\"><h3>14.3 STANDARD PRIVILEGES \u2014 61\u2013120 MONTHS<\/h3><p>Eligible monthly Plans paid over 61\u2013120 months receive:<\/p><ul><li>21-Day Consideration Period; and<\/li><li>14-Year Refund Commitment.<\/li><\/ul><\/div><\/section><p><!-- 15. Consideration Period --><\/p><section class=\"terms-section\"><h2>15. 21-DAY CONSIDERATION PERIOD<\/h2><p>Every eligible Plan Holder has 21 days from the date the Plan is created to consider whether the Plan is suitable.<\/p><p>The date the Plan is created is Day 1.<\/p><p>Cancellation should be requested in writing.<\/p><p>Subject to applicable law and completion of the cancellation process, eligible payments will be refunded.<\/p><p>Nothing in these Terms limits any statutory cancellation or withdrawal rights that cannot legally be excluded.<\/p><\/section><p><!-- 16. Refund Commitments --><\/p><section class=\"terms-section\"><h2>16. REFUND COMMITMENTS<\/h2><div class=\"terms-subsection\"><h3>16.1 14-YEAR REFUND COMMITMENT<\/h3><p>Where applicable, if a qualifying Plan has not been called upon within 14 years from the applicable commencement date, Elysium will refund the Plan Fee in accordance with the Refund Commitment and assume responsibility for the funeral provision at the time of need, subject to the Plan Documentation and applicable law.<\/p><p>For monthly Plans, the 14-Year Refund Commitment begins when the Plan has been fully paid unless the Plan Documentation states otherwise.<\/p><\/div><div class=\"terms-subsection\"><h3>16.2 10-YEAR LEGACY REFUND COMMITMENT<\/h3><p>For qualifying full-paying Plans, where the Plan Holder dies after the tenth anniversary but before the fourteenth anniversary, Elysium will refund the qualifying Plan Fee to the named Beneficiary or Beneficiaries when the fourteenth anniversary is reached, subject to the applicable terms.<\/p><p>Beneficiaries must satisfy Elysium\u2019s identity and verification requirements.<\/p><p>Where a Beneficiary is under 18, payment will be deferred until the applicable legal age or otherwise dealt with in accordance with applicable law.<\/p><\/div><\/section><p><!-- 17. Free Standard Will --><\/p><section class=\"terms-section\"><h2>17. FREE STANDARD WILL<\/h2><p>Eligible full-paying Plan Holders may receive a professionally prepared Standard Will through an Elysium-appointed Will writer or legal professional.<\/p><p>The Will service is subject to the professional and legal requirements applicable in the relevant country.<\/p><p>Additional legal work, complex Wills, notarisation, registration, translation or other services may incur additional charges payable by the Plan Holder.<\/p><p>If the Plan Holder declines the Will, no cash alternative will be provided.<\/p><p>Where legally permissible, if the Plan is cancelled within the first five years, Elysium may deduct the applicable cost of the Will from any refund due.<\/p><\/section><p><!-- 18. Charitable Donations --><\/p><section class=\"terms-section\"><h2>18. CHARITABLE DONATIONS<\/h2><p>Where included within the applicable Privilege Collection:<\/p><p><strong>Full-paying Plans<\/strong><\/p><p>A donation of up to \u20ac40 may be made to a charity selected from Elysium\u2019s approved charity list.<\/p><p><strong>Eligible monthly Plans up to 60 months<\/strong><\/p><p>A donation of up to \u20ac20 may be made.<\/p><p>Donations will normally be made after the applicable Consideration Period and subject to the Plan remaining active.<\/p><\/section><p><!-- 19. Tree Planting --><\/p><section class=\"terms-section\"><h2>19. TREE PLANTING<\/h2><p>Where included within the applicable Privilege Collection, Elysium will arrange tree planting through its environmental partner.<\/p><p>Tree planting may take place after the applicable Consideration Period and establishment period.<\/p><p>If the Plan is cancelled before the planting instruction is issued, Elysium may cancel the planting.<\/p><p>Eligible full-paying Plans may also receive anniversary tree planting where specified.<\/p><\/section><p><!-- 20. Transfer-In Refund --><\/p><section class=\"terms-section\"><h2>20. TRANSFER-IN REFUND<\/h2><p>Eligible new full-paying Plan Holders transferring from another funeral-plan provider may qualify for reimbursement of a cancellation fee charged by the previous provider.<\/p><p>Elysium may require:<\/p><ul><li>original Plan documentation;<\/li><li>evidence of cancellation;<\/li><li>evidence of the cancellation fee;<\/li><li>evidence of the refund; and<\/li><li>any other reasonable supporting documentation.<\/li><\/ul><p>Elysium will pay the lower of the verified cancellation fee or the maximum amount specified in the applicable Transfer-In terms.<\/p><\/section><p><!-- 21. 12 Draws --><\/p><section class=\"terms-section\"><h2>21. 12 DRAWS OF GOOD LUCK<\/h2><p>Eligible Plans may participate in Elysium\u2019s annual 12 Draws of Good Luck.<\/p><p>Full-paying Plans will normally be entered into the draw applicable to the month in which the Plan was created.<\/p><p>Eligible monthly Plans will normally be entered after the Plan has been fully paid.<\/p><p>A Plan must be up to date with payments to remain eligible.<\/p><p>Elysium Assist and Non-Resident Plans are not eligible.<\/p><p>A Plan may remain eligible for future draws until it:<\/p><ul><li>wins;<\/li><li>is cancelled;<\/li><li>is called upon; or<\/li><li>reaches the applicable Refund Commitment.<\/li><\/ul><p>Any prize or benefit is subject to the promotional terms applicable to the relevant draw.<\/p><\/section><p><!-- 22. Transferring Your Plan --><\/p><section class=\"terms-section\"><h2>22. TRANSFERRING YOUR PLAN<\/h2><p>A Plan may, subject to Elysium approval and applicable law, be transferred after the qualifying period specified in the Plan Documentation.<\/p><p>For Plans requiring five years before transfer:<\/p><ul><li>full-paying Plans become eligible after five years;<\/li><li>monthly Plans become eligible after the final payment has been received.<\/li><\/ul><p>Following an approved transfer:<\/p><ul><li>draw eligibility may cease;<\/li><li>additional services may be chargeable;<\/li><li>Elysium is not responsible for private family disputes;<\/li><li>third-party costs remain payable where applicable; and<\/li><li>Celebrant services may be subject to separate terms or administration charges.<\/li><\/ul><p>Requests to change a Beneficiary must be made in writing to:<\/p><p><a href=\"mailto:clientcare@elysiumfuneralplans.com\">clientcare@elysiumfuneralplans.com<\/a><\/p><\/section><p><!-- 23. Payment --><\/p><section class=\"terms-section\"><h2>23. PAYMENT<\/h2><p>Plans may be paid:<\/p><ul><li>in full by approved debit or credit card;<\/li><li>by bank transfer;<\/li><li>monthly for up to 120 months interest-free where available;<\/li><li>by Continuous Card Authority; or<\/li><li>by SEPA Direct Debit.<\/li><\/ul><p>The minimum deposit for monthly Plans is \u20ac500, unless otherwise stated in the individual Plan Documentation.<\/p><p>A higher deposit may be requested to reduce monthly payments.<\/p><p>Payment methods may vary according to the country in which the Plan is purchased.<\/p><\/section><p><!-- 24. Missed Payments --><\/p><section class=\"terms-section\"><h2>24. MISSED PAYMENTS<\/h2><p>If a monthly payment is missed, Elysium will notify the Plan Holder and may attempt to collect the payment again.<\/p><p>If payment remains outstanding, Elysium may request an alternative payment method.<\/p><p>Where a Plan becomes materially overdue, Elysium may suspend the Plan in accordance with the Plan Documentation and applicable law.<\/p><p>If the Plan is suspended and the Plan Holder dies during the suspension period, Elysium\u2019s obligations will be determined by the Plan Documentation, outstanding balance and applicable law.<\/p><\/section><p><!-- 25. Incomplete Plans --><\/p><section class=\"terms-section\"><h2>25. INCOMPLETE PLANS AT TIME OF NEED<\/h2><p>If a monthly Plan has an outstanding balance when it is called upon, the outstanding contractual balance may need to be paid before the full funeral provision can be provided.<\/p><p>The Next of Kin or authorised representative will be advised of the outstanding amount.<\/p><p>Where the outstanding balance is not paid, Elysium\u2019s obligations will be determined by the applicable Plan terms and law.<\/p><\/section><p><!-- 26. Cancellation --><\/p><section class=\"terms-section\"><h2>26. CANCELLATION<\/h2><div class=\"terms-subsection\"><h3>26.1 WITHIN THE CONSIDERATION PERIOD<\/h3><p><strong>Cancellation requests made within the 21-Day Consideration Period should be sent to:<\/strong><\/p><p><a href=\"mailto:clientcare@elysiumfuneralplans.com\">clientcare@elysiumfuneralplans.com<\/a><\/p><p>To enable us to identify the relevant Plan and process the request, the cancellation request must include the following information:<\/p><ul><li>Full name;<\/li><li>Address;<\/li><li>Date of birth and<\/li><li>Plan Number.<\/li><\/ul><p>Refunds will be made to the original payment method, subject to applicable law.\u00a0<\/p><p>Elysium will <strong>not, under any circumstances,<\/strong> refund to a third party account.<\/p><\/div><div class=\"terms-subsection\"><h3>26.2 AFTER THE CONSIDERATION PERIOD<\/h3><\/div><div class=\"terms-subsection\"><p><strong>Cancellation requests made after the 21-Day Consideration Period should be submitted to:<\/strong><\/p><p><a href=\"mailto:clientcare@elysiumfuneralplans.com\">clientcare@elysiumfuneralplans.com<\/a><\/p><p>To enable us to identify the relevant Plan and process the request, the cancellation request must include the following information:<\/p><ul><li><p>Full name;<\/p><\/li><li><p>Address;<\/p><\/li><li><p>Date of birth; and<\/p><\/li><li><p>Plan Number.<\/p><\/li><\/ul><p>Once a valid cancellation request has been received, the refund will be processed within <strong>5 working days<\/strong>. A <strong>cancellation fee of \u20ac495 per cancelled Plan<\/strong> will apply.<\/p><p>Where the Plan Holder(s) have received a refund under the Elysium <strong>\u2018Transfer-In\u2019 <\/strong>scheme, any amount previously refunded under that scheme will also be deducted from the amount payable upon cancellation.<\/p><p>We reserve the right to offset any amount due against an associated Plan that is in arrears at the time the refund is processed.<\/p><p>Refunds will be made to the original payment method, subject to applicable law.\u00a0<\/p><p>Elysium will <strong>not, under any circumstances,<\/strong> refund to a third party account.<\/p><p>Nothing in these Terms is intended to remove or restrict any statutory consumer right.<\/p><\/div><\/section><p><!-- 27. Data Protection --><\/p><section class=\"terms-section\"><h2>27. DATA PROTECTION<\/h2><p>Elysium processes personal information in accordance with the EU General Data Protection Regulation and applicable national data-protection legislation.<\/p><p>Information may be processed for the purpose of:<\/p><ul><li>administering Plans;<\/li><li>processing payments;<\/li><li>arranging funeral services;<\/li><li>arranging burial or cremation;<\/li><li>arranging repatriation;<\/li><li>providing Will services;<\/li><li>providing Celebrant services;<\/li><li>providing pet-related services;<\/li><li>communicating with clients;<\/li><li>maintaining records;<\/li><li>complying with legal obligations; and<\/li><li>preventing fraud or misuse.<\/li><\/ul><p>Information may be shared where necessary with appointed Funeral Directors, funeral facilities, crematoria, cemeteries, Celebrants, Will writers, legal professionals, payment providers and other authorised service providers.<\/p><p>Further information is contained within the Elysium Privacy Policy.<\/p><\/section><p><!-- 28. Local Law --><\/p><section class=\"terms-section\"><h2>28. LOCAL LAW AND FUNERAL REQUIREMENTS<\/h2><p>Funeral, burial, cremation and repatriation arrangements are subject to the law and operational requirements of the country where the relevant service takes place.<\/p><p>These may include requirements imposed by:<\/p><ul><li>government authorities;<\/li><li>civil registries;<\/li><li>health authorities;<\/li><li>Funeral Directors;<\/li><li>tanatorios;<\/li><li>casas mortu\u00e1rias;<\/li><li>crematoria;<\/li><li>cemeteries;<\/li><li>airlines; and<\/li><li>other authorised providers.<\/li><\/ul><p>Where a service cannot reasonably be provided exactly as described because of legal, regulatory or operational requirements, Elysium will seek to provide a reasonable alternative within the scope and value of the Plan, where permitted by law.<\/p><\/section><p><!-- 29. Circumstances Beyond Control --><\/p><section class=\"terms-section\"><h2>29. CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL<\/h2><p>Elysium will use reasonable care and skill in arranging the services included within a Plan.<\/p><p>Elysium will not be responsible for delay or inability to provide a service where caused by circumstances beyond our reasonable control, including:<\/p><ul><li>changes in law;<\/li><li>government requirements;<\/li><li>crematorium or cemetery availability;<\/li><li>airline restrictions;<\/li><li>extreme weather;<\/li><li>strikes;<\/li><li>civil emergencies;<\/li><li>public-health restrictions; or<\/li><li>other circumstances outside reasonable control.<\/li><\/ul><p>Where this occurs, Elysium will seek to provide an appropriate alternative where reasonably possible.<\/p><\/section><p><!-- 30. Consumer Rights --><\/p><section class=\"terms-section\"><h2>30. CONSUMER RIGHTS<\/h2><p>Nothing in these Terms is intended to exclude or restrict mandatory consumer rights applicable in Spain, Portugal, Cyprus, the European Union or elsewhere.<\/p><p>Where applicable law provides rights greater than those stated in these Terms, those rights will apply.<\/p><p>Mandatory legal requirements will prevail over any conflicting provision of these Terms.<\/p><\/section><p><!-- 31. APPLICABLE LAW AND JURISDICTION<\/h2><p>Elysium will comply with the mandatory laws and consumer-protection requirements applicable to the Plan and the country concerned.<\/p><p>The applicable contractual law and jurisdiction will be identified in the individual Plan Documentation where required.<\/p><p>Nothing in these Terms prevents a consumer from exercising mandatory rights available under the law applicable to them.<\/p><\/section><p><!-- 33. Changes --><\/p><section class=\"terms-section\"><h2>33. CHANGES TO THESE TERMS<\/h2><p>Elysium may update these Terms where reasonably necessary to reflect changes to:<\/p><ul><li>our services;<\/li><li>our business;<\/li><li>technology;<\/li><li>funeral arrangements;<\/li><li>legal requirements;<\/li><li>regulatory requirements; or<\/li><li>operational procedures.<\/li><\/ul><p>Changes will not retrospectively remove contractual rights already acquired by a Plan Holder where prohibited by law.<\/p><p>The version applicable to an individual Plan will normally be the version supplied when the Plan was created, subject to mandatory legal requirements.<\/p><\/section><p><!-- 34. Order of Precedence --><\/p><section class=\"terms-section\"><h2>34. ORDER OF PRECEDENCE<\/h2><p>The following documents should be read together:<\/p><ol><li>Applicable mandatory law;<\/li><li>Individual Plan Documentation;<\/li><li>these Terms &amp; Conditions; and<\/li><li>any applicable service-specific terms.<\/li><\/ol><p>Where there is a conflict, mandatory law will prevail.<\/p><p>Where the individual Plan Documentation contains specific terms relating to the Plan purchased, those specific terms will apply to that provision.<\/p><\/section><p><!-- 35. General --><\/p><section class=\"terms-section\"><h2>35.
