1. À PROPOS DES PRÉSENTES CONDITIONS GÉNÉRALES

Les présentes conditions générales régissent l'achat et la fourniture de plans funéraires prépayés ainsi que des services associés proposés par Elysium Funeral Plans SL (“ Elysium ”, “ nous ”, “ notre ” ou “ nos ”).

En souscrivant à un plan funéraire Elysium, le titulaire du plan (“ vous ” ou “ votre ”) accepte les présentes conditions générales ainsi que la documentation spécifique au plan émise par Elysium.

Les présentes Conditions générales s'appliquent aux Formules souscrites en Espagne, au Portugal et à Chypre, sous réserve, dans tous les cas, des dispositions légales impératives et des exigences en matière de protection des consommateurs applicables dans le pays concerné.

2.2 NOS SERVICES

Elysium propose des plans funéraires prépayés et les services funéraires associés aux clients éligibles en Espagne, au Portugal et à Chypre.

Les services funéraires sont organisés par Elysium et ses entrepreneurs de pompes funèbres désignés, ses professionnels du secteur funéraire et d'autres prestataires de services agréés.

La terminologie locale peut varier, notamment :

  • Espagne : Entrepreneur de pompes funèbres / Entreprise de pompes funèbres / Salle mortuaire
  • Portugal : Agence funéraire / Salle mortuaire
  • Chypre : Entrepreneur de pompes funèbres / Salle funéraire / Chapelle funéraire

3. DÉFINITIONS

Aux fins des présentes Conditions générales :

Plan désigne le plan funéraire prépayé souscrit auprès d'Elysium.
Titulaire du contrat Désigne la personne dont le nom figure dans le Plan.
Documentation relative au plan Désigne la documentation individuelle remise au souscripteur du plan, confirmant le plan choisi, le prix, les modalités de paiement et les prestations applicables.
Proche parent Désigne la personne légalement habilitée ou autrement désignée par Elysium pour communiquer avec nous au sujet des démarches à effectuer à la suite du décès du titulaire du contrat.
Entrepreneur de pompes funèbres Désigne un professionnel des pompes funèbres désigné par Elysium ou un prestataire de services funéraires local agréé.
Frais liés au plan Désigne le prix total indiqué dans la documentation du Plan.
Collection Privilege Désigne les avantages supplémentaires applicables aux régimes éligibles en fonction du type de régime et du mode de paiement.

4. NOS FORFAITS FUNÉRAIRES

Les principaux plans proposés par Elysium sont les suivants :

4.1 ELYSIUM ASSIST

Une formule de crémation directe spécialement proposée aux nouveaux clients éligibles âgés de 75 ans et plus, sous réserve du respect des conditions d'éligibilité applicables.

Le montant de l'abonnement à Elysium Assist doit être réglé dans son intégralité.

4.2 CLARTÉ

Une formule de crémation directe, sans assemblée de personnes en deuil ni cérémonie funéraire religieuse ou humaniste.

4.3 TRANQUILLITÉ

Un forfait funéraire traditionnel comprenant l'inhumation ou la crémation ainsi que la prise en charge des personnes en deuil, sans cérémonie funéraire religieuse ou humaniste.

4.4 SÉRÉNITÉ

Un forfait funéraire traditionnel comprenant l'inhumation ou la crémation, la présence des proches et une cérémonie funéraire religieuse ou humaniste.

4.5 UNITÉ

Un plan de rapatriement proposant des services de rapatriement spécifiques depuis l'Espagne, le Portugal ou Chypre vers un pays d'accueil éligible, sous réserve des conditions prévues dans la documentation relative au plan et de la législation applicable.

4.6 PLAN D'AMÉNAGEMENT

Un contrat prévoyant une cérémonie de célébration de la vie animée par un célébrant d’Elysium avant le décès du souscripteur.

Les prestations funéraires en cas de décès restent régies par le contrat d'assurance obsèques sous-jacent.

5. ELYSIUM ASSIST — PERSONNES DE PLUS DE 75 ANS

5.1 CONDITIONS D'ADMISSIBILITÉ

Elysium Assist est accessible aux nouveaux clients âgés de 75 ans et plus qui remplissent les conditions d'éligibilité applicables d'Elysium au moment de la souscription.

Les souscripteurs actuels d'un contrat « Elysium » ne peuvent pas passer à un contrat « Elysium Assist ».

5.2 PAIEMENT

Elysium Assist n'est disponible qu'après paiement intégral.

Ce produit n'est pas proposé avec un paiement mensuel ni un échelonnement des paiements.

5.3 PRIX

Le prix actuellement annoncé pour Elysium Assist est de €1,800.

Le prix applicable sera confirmé dans la documentation propre à chaque plan.

5.4 DISPOSITIONS RELATIVES AUX FUNÉRAILLES

Elysium Assist propose une formule simple de crémation directe.

Seuls les biens et services expressément mentionnés dans la documentation du programme Elysium Assist sont couverts.

Tout ce qui n'est pas expressément mentionné est exclu, sauf accord écrit ultérieur.

5.5 AUCUNE COLLECTE DE DONNÉES À CARACTÈRE CONFIDENTIEL

Elysium Assist ne donne droit à aucune offre de la gamme Elysium Privilege Collection.

Cela comprend, sauf convention contraire expresse :

  • Le libre arbitre ;
  • don caritatif ;
  • plantation d'arbres ;
  • Engagements de remboursement ;
  • Avantages liés au transfert vers notre établissement ;
  • 12 tirages porte-bonheur ; et
  • d'autres avantages promotionnels.

5.6 MISE À NIVEAU

Un contrat « Elysium Assist » peut à tout moment être transformé en un autre contrat funéraire Elysium disponible.

La mise à niveau sera soumise aux conditions suivantes :

  • le plan choisi ;
  • le prix en vigueur au moment du surclassement ;
  • les Conditions générales applicables ; et
  • tout paiement supplémentaire dû.

5.7 OFFRES

L'offre « Elysium Assist » ne peut être cumulée avec aucune autre offre, promotion ou réduction d'Elysium, sauf accord écrit expressément stipulé.

5.8 TRANSFERT EN ENTRÉE

Lorsque le service « Elysium Assist » est utilisé dans le cadre d'un transfert, les frais d'annulation, de gestion ou autres frais imposés par un autre prestataire de plans funéraires ne seront pas remboursés, sauf accord écrit explicite.

5.9 EXIGENCES LOCALES

Les dispositions funéraires seront prises par l'intermédiaire d'un prestataire de services local agréé et approprié ; elles restent soumises à la disponibilité locale, aux exigences opérationnelles et à la législation en vigueur.

6. PLAN CLARITY

6.1 INCLUS

Sous réserve de la disponibilité locale et de la législation en vigueur, le forfait Clarity comprend :

  1. Crémation sans présence des proches dans un crématorium désigné.
  2. Frais de crémation.
  3. Les services d'un entrepreneur de pompes funèbres désigné par Elysium sont nécessaires pour organiser la crémation.
  4. Prise en charge et transport du défunt depuis son domicile, une maison de retraite, un hôpital ou un lieu de repos agréé vers l'établissement désigné.
  5. Soins et préparation du défunt, y compris la préparation hygiénique et le retrait du stimulateur cardiaque lorsque cela est nécessaire ou autorisé.
  6. Cercueil simple adapté à la crémation.
  7. Simple urn.
  8. Return of ashes to the family in the relevant country, subject to local arrangements.
  9. 24-hour bereavement line with English-speaking operators.
  10. Relevant death-certification documentation.
  11. Cremation documentation required for lawful transportation of ashes, where applicable.
  12. Applicable Privilege Collection where the Plan qualifies.

6.2 EXCLUSIONS

Unless expressly included in the Plan Documentation, Clarity does not include:

  • Funeral Directors not appointed by Elysium;
  • face-to-face Funeral Director appointments;
  • viewing of the deceased;
  • dressing the deceased in personal clothing;
  • personal items placed within the coffin;
  • family attendance at the crematorium;
  • funeral ceremonies or services;
  • church, religious or humanist services;
  • additional mortuary storage;
  • choice of cremation date, time or location;
  • wakes or catering;
  • obituary notices;
  • flowers or floral tributes;
  • interment of ashes;
  • headstones, plaques or memorials;
  • repatriation;
  • transfers not expressly included;
  • audio-visual equipment;
  • family or guest travel costs; or
  • goods or services not expressly included.

7. TRANQUILITY PLAN

7.1 INCLUDED

Subject to local availability and applicable law, Tranquility includes:

  1. Elysium-appointed Funeral Director services.
  2. Advice concerning death certification and registration.
  3. Cremation fee where cremation is selected.
  4. Collection and transportation of the deceased.
  5. Care and preparation of the deceased.
  6. Simple wood-effect coffin suitable for burial or cremation.
  7. Up to four days’ mortuary or Chapel of Rest provision, subject to local facility arrangements.
  8. One day of viewing for family and friends, subject to local facility arrangements.
  9. Transportation to the appointed cemetery or crematorium.
  10. Relevant death-certification documentation.
  11. 24-hour bereavement line with English-speaking operators.
  12. Simple urn where cremation is selected.
  13. Cremation documentation where applicable.
  14. Applicable Privilege Collection where the Plan qualifies.

7.2 EXCLUSIONS

Unless expressly included, Tranquility does not include:

  • Funeral Directors not appointed by Elysium;
  • religious, humanist or other ceremony costs;
  • additional venue costs;
  • church or religious venue costs beyond the agreed provision;
  • wakes or catering;
  • obituary notices;
  • additional flowers;
  • burial plot or grave purchase;
  • headstone or memorial;
  • memorial maintenance;
  • guest transportation;
  • additional printed materials;
  • audio-visual equipment;
  • interment or distribution of ashes;
  • repatriation;
  • transfers not expressly included; or
  • any other goods or services not expressly included.

8. SERENITY PLAN

8.1 INCLUDED

Subject to local availability and applicable law, Serenity includes:

  1. Elysium-appointed Funeral Director services.
  2. Advice concerning death certification and registration.
  3. Collection and transportation of the deceased.
  4. Care and preparation of the deceased.
  5. Quality veneered coffin suitable for burial or cremation.
  6. Minister or Celebrant for the funeral service, where applicable.
  7. Funeral staff required to conduct the service.
  8. Cremation fee where cremation is selected.
  9. Up to five days’ mortuary or Chapel of Rest provision, subject to local facility arrangements.
  10. One day of viewing for family and friends, subject to local facility arrangements.
  11. Transportation to the appointed cemetery or crematorium.
  12. Relevant death-certification documentation.
  13. 24-hour bereavement line with English-speaking operators.
  14. Small floral spray.
  15. Simple urn where cremation is selected.
  16. Cremation documentation where applicable.
  17. Applicable Privilege Collection where the Plan qualifies.

8.2 EXCLUSIONS

Unless expressly included, Serenity does not include:

  • Funeral Directors not appointed by Elysium;
  • additional venue costs;
  • church or religious venue costs beyond the agreed provision;
  • wakes or catering;
  • obituary notices;
  • additional flowers;
  • burial plot;
  • headstone or memorial;
  • memorial maintenance;
  • transportation of funeral guests;
  • additional printed materials;
  • audio-visual equipment;
  • interment or distribution of ashes;
  • repatriation;
  • transfers not expressly included; or
  • any other goods or services not expressly included.

9. UNITY REPATRIATION PLAN

9.1 PURPOSE

The Unity Plan provides specified repatriation services from Spain, Portugal or Cyprus to an eligible receiving country.

The receiving country and scope of repatriation will be confirmed in the individual Plan Documentation.

9.2 INCLUDED

Subject to the individual Plan, local availability and applicable law, Unity may include:

  1. Legal and administrative formalities.
  2. Liaison with relevant authorities.
  3. Elysium-appointed Funeral Director in the originating country.
  4. Elysium-appointed Funeral Director in the receiving country.
  5. Collection and transportation of the deceased.
  6. Care and preparation for transportation.
  7. Specified mortuary provision.
  8. Coffin suitable for transportation.
  9. Transportation to the airport.
  10. Flight for the deceased.
  11. Receipt by the appointed Funeral Director in the receiving country.
  12. Relevant certification and registration assistance.
  13. 24-hour bereavement line with English-speaking operators.

If the Next of Kin chooses a Funeral Director other than the Elysium-appointed Funeral Director in the receiving country, any contribution specified in the Plan may become void.

Where a contribution is available, it is limited to the amount stated in the Plan Documentation.

9.3 EXCLUSIONS

Unless expressly included, Unity does not include:

  • Funeral Directors not appointed by Elysium;
  • additional venue costs;
  • wakes or catering;
  • obituary notices;
  • flowers;
  • burial plots;
  • headstones or memorials;
  • guest transportation;
  • additional printed materials;
  • audio-visual equipment;
  • additional airport or handling charges;
  • exceptional airline, governmental or authority charges; or
  • any other goods or services not expressly included.

10. ELYSIUM NON-RESIDENT PLAN

10.1 PURPOSE

The Elysium Non-Resident Plan is designed for individuals who are not resident in Spain, Portugal or Cyprus, but who own property, spend time in or regularly visit one or more of these countries.

The Plan allows the Plan Holder to secure an agreed funeral-plan price while retaining flexibility should they ultimately die outside the covered countries.

10.2 €500 DEPOSIT

A €500 deposit is payable to secure the agreed Plan price.

The agreed price will be confirmed in the individual Plan Documentation.

10.3 DEATH IN SPAIN, PORTUGAL OR CYPRUS

If the Plan Holder dies in Spain, Portugal or Cyprus, Elysium will arrange the funeral in accordance with the selected Plan and applicable Plan Documentation.

10.4 DEATH OUTSIDE THE COVERED COUNTRIES

If the Plan Holder dies outside Spain, Portugal or Cyprus, the Non-Resident Plan does not provide for Elysium to arrange or pay for a funeral in that country.

Subject to the conditions of the Plan, the €500 deposit will be returned to the Next of Kin less a €100 administration fee.

The amount refundable will therefore be €400.

10.5 ADMINISTRATION FEE

The €100 administration fee covers administration associated with closing the Non-Resident Plan and processing the applicable refund.

The administration fee is non-refundable.

10.6 FUNERAL OUTSIDE THE COVERED COUNTRIES

Elysium does not arrange, manage, fund or accept responsibility for funeral services taking place outside Spain, Portugal or Cyprus under the Non-Resident Plan.

The Next of Kin or family is responsible for making any funeral arrangements in the country where the death occurs.

10.7 NO PRIVILEGE COLLECTION

The Elysium Non-Resident Plan does not qualify for any Elysium Privilege Collection.

10.8 TRANSFER-IN

The Non-Resident Plan does not include reimbursement of cancellation, administration or other charges imposed by another funeral-plan provider unless expressly agreed in writing.

10.9 CHANGE OF RESIDENCY

The Plan Holder should notify Elysium if they become resident in Spain, Portugal or Cyprus.

Elysium may review the Plan and confirm whether an alternative Plan is more appropriate.

11. FAMILY PLAN

A Family Plan provides funeral-plan arrangements for eligible members of the same family.

The qualifying Founder Plans must be purchased in full unless otherwise stated in the Family Plan Documentation.

Additional eligible family members may be added subject to the applicable Family Plan terms and pricing.

12. CHILDREN’S PLAN

Elysium may provide one free Children’s Clarity Plan for an eligible child under 18 for each qualifying full-paying adult Plan.

The Children’s Plan:

  • is a Clarity Direct Cremation Plan;
  • has no Privilege Collection;
  • is subject to eligibility requirements;
  • ends automatically when the child reaches 18;
  • cannot be transferred.

Eligible relationships may include children, stepchildren, grandchildren and step-grandchildren.

Evidence of the relationship may be required.

The qualifying adult Plan must remain active.

If the qualifying adult Plan is cancelled or called upon, the Children’s Plan will cease.

Where available, the Children’s Plan may be upgraded to Tranquility or Serenity by paying the applicable difference.

An upgraded Children’s Plan does not automatically qualify for Privileges.

13. LIVING PLAN

A Living Plan incorporates an Elysium Celebrant-led Celebration of Life before the Plan Holder’s death.

The Celebration of Life may take place over a day or weekend as agreed with the Plan Holder and Celebrant.

The funeral provision following death remains governed by the underlying Elysium Funeral Plan.

Additional Celebrant terms may apply.

14. PRIVILEGE COLLECTIONS

Privilege Collections apply only to Plans expressly identified as eligible.

14.1 PREMIER PRIVILEGES — FULL PAYERS

Eligible full-paying Plans may receive:

  • 21-Day Consideration Period;
  • 14-Year Refund Commitment;
  • 10-Year Legacy Refund Commitment;
  • Free Children’s Plan;
  • Free Standard Will;
  • €40 charitable donation;
  • plantation d'arbres ;
  • anniversary tree planting where applicable;
  • Transfer-In Refund eligibility;
  • 12 Draws of Good Luck eligibility; and
  • eligibility for Joint or Family Plans.

Elysium Assist and the Non-Resident Plan are excluded from Privilege Collections.

14.2 CLASSIC PRIVILEGES — UP TO 60 MONTHS

Eligible monthly Plans paid over up to 60 months may receive:

  • 21-Day Consideration Period;
  • 14-Year Refund Commitment;
  • €20 charitable donation;
  • tree planting; and
  • eligibility for the 12 Draws of Good Luck once fully paid.

14.3 STANDARD PRIVILEGES — 61–120 MONTHS

Eligible monthly Plans paid over 61–120 months receive:

  • 21-Day Consideration Period; and
  • Engagement de remboursement sur 14 ans.

15. 21-DAY CONSIDERATION PERIOD

Every eligible Plan Holder has 21 days from the date the Plan is created to consider whether the Plan is suitable.

The date the Plan is created is Day 1.

Cancellation should be requested in writing.

Subject to applicable law and completion of the cancellation process, eligible payments will be refunded.

Nothing in these Terms limits any statutory cancellation or withdrawal rights that cannot legally be excluded.

16. REFUND COMMITMENTS

16.1 14-YEAR REFUND COMMITMENT

Where applicable, if a qualifying Plan has not been called upon within 14 years from the applicable commencement date, Elysium will refund the Plan Fee in accordance with the Refund Commitment and assume responsibility for the funeral provision at the time of need, subject to the Plan Documentation and applicable law.

For monthly Plans, the 14-Year Refund Commitment begins when the Plan has been fully paid unless the Plan Documentation states otherwise.

16.2 10-YEAR LEGACY REFUND COMMITMENT

For qualifying full-paying Plans, where the Plan Holder dies after the tenth anniversary but before the fourteenth anniversary, Elysium will refund the qualifying Plan Fee to the named Beneficiary or Beneficiaries when the fourteenth anniversary is reached, subject to the applicable terms.

Beneficiaries must satisfy Elysium’s identity and verification requirements.

Where a Beneficiary is under 18, payment will be deferred until the applicable legal age or otherwise dealt with in accordance with applicable law.

17. FREE STANDARD WILL

Eligible full-paying Plan Holders may receive a professionally prepared Standard Will through an Elysium-appointed Will writer or legal professional.

The Will service is subject to the professional and legal requirements applicable in the relevant country.

Additional legal work, complex Wills, notarisation, registration, translation or other services may incur additional charges payable by the Plan Holder.

If the Plan Holder declines the Will, no cash alternative will be provided.

Where legally permissible, if the Plan is cancelled within the first five years, Elysium may deduct the applicable cost of the Will from any refund due.

18. CHARITABLE DONATIONS

Where included within the applicable Privilege Collection:

Full-paying Plans

A donation of up to €40 may be made to a charity selected from Elysium’s approved charity list.

Eligible monthly Plans up to 60 months

A donation of up to €20 may be made.

Donations will normally be made after the applicable Consideration Period and subject to the Plan remaining active.

19. TREE PLANTING

Where included within the applicable Privilege Collection, Elysium will arrange tree planting through its environmental partner.

Tree planting may take place after the applicable Consideration Period and establishment period.

If the Plan is cancelled before the planting instruction is issued, Elysium may cancel the planting.

Eligible full-paying Plans may also receive anniversary tree planting where specified.

20. TRANSFER-IN REFUND

Eligible new full-paying Plan Holders transferring from another funeral-plan provider may qualify for reimbursement of a cancellation fee charged by the previous provider.

Elysium may require:

  • original Plan documentation;
  • evidence of cancellation;
  • evidence of the cancellation fee;
  • evidence of the refund; and
  • any other reasonable supporting documentation.

Elysium will pay the lower of the verified cancellation fee or the maximum amount specified in the applicable Transfer-In terms.

21. 12 DRAWS OF GOOD LUCK

Eligible Plans may participate in Elysium’s annual 12 Draws of Good Luck.

Full-paying Plans will normally be entered into the draw applicable to the month in which the Plan was created.

Eligible monthly Plans will normally be entered after the Plan has been fully paid.

A Plan must be up to date with payments to remain eligible.

Elysium Assist and Non-Resident Plans are not eligible.

A Plan may remain eligible for future draws until it:

  • wins;
  • is cancelled;
  • is called upon; or
  • reaches the applicable Refund Commitment.

Any prize or benefit is subject to the promotional terms applicable to the relevant draw.

22. TRANSFERRING YOUR PLAN

A Plan may, subject to Elysium approval and applicable law, be transferred after the qualifying period specified in the Plan Documentation.

For Plans requiring five years before transfer:

  • full-paying Plans become eligible after five years;
  • monthly Plans become eligible after the final payment has been received.

Following an approved transfer:

  • draw eligibility may cease;
  • additional services may be chargeable;
  • Elysium is not responsible for private family disputes;
  • third-party costs remain payable where applicable; and
  • Celebrant services may be subject to separate terms or administration charges.

Requests to change a Beneficiary must be made in writing to:

23. PAYMENT

Plans may be paid:

  • in full by approved debit or credit card;
  • by bank transfer;
  • monthly for up to 120 months interest-free where available;
  • by Continuous Card Authority; or
  • by SEPA Direct Debit.

The minimum deposit for monthly Plans is €500, unless otherwise stated in the individual Plan Documentation.

A higher deposit may be requested to reduce monthly payments.

Payment methods may vary according to the country in which the Plan is purchased.

24. MISSED PAYMENTS

If a monthly payment is missed, Elysium will notify the Plan Holder and may attempt to collect the payment again.

If payment remains outstanding, Elysium may request an alternative payment method.

Where a Plan becomes materially overdue, Elysium may suspend the Plan in accordance with the Plan Documentation and applicable law.

If the Plan is suspended and the Plan Holder dies during the suspension period, Elysium’s obligations will be determined by the Plan Documentation, outstanding balance and applicable law.

25. INCOMPLETE PLANS AT TIME OF NEED

If a monthly Plan has an outstanding balance when it is called upon, the outstanding contractual balance may need to be paid before the full funeral provision can be provided.

The Next of Kin or authorised representative will be advised of the outstanding amount.

Where the outstanding balance is not paid, Elysium’s obligations will be determined by the applicable Plan terms and law.

26. CANCELLATION

26.1 WITHIN THE CONSIDERATION PERIOD

Cancellation requests made within the 21-Day Consideration Period should be sent to:

To enable us to identify the relevant Plan and process the request, the cancellation request must include the following information:

  • Full name;
  • Address;
  • Date of birth and
  • Plan Number.

Refunds will be made to the original payment method, subject to applicable law. 

Elysium will not, under any circumstances, refund to a third party account.

26.2 AFTER THE CONSIDERATION PERIOD

Cancellation requests made after the 21-Day Consideration Period should be submitted to:

To enable us to identify the relevant Plan and process the request, the cancellation request must include the following information:

  • Full name;

  • Address;

  • Date of birth; and

  • Plan Number.

Once a valid cancellation request has been received, the refund will be processed within 5 working days. A cancellation fee of €495 per cancelled Plan will apply.

Where the Plan Holder(s) have received a refund under the Elysium ‘Transfer-In’ scheme, any amount previously refunded under that scheme will also be deducted from the amount payable upon cancellation.

We reserve the right to offset any amount due against an associated Plan that is in arrears at the time the refund is processed.

Refunds will be made to the original payment method, subject to applicable law. 

Elysium will not, under any circumstances, refund to a third party account.

Nothing in these Terms is intended to remove or restrict any statutory consumer right.

27. DATA PROTECTION

Elysium processes personal information in accordance with the EU General Data Protection Regulation and applicable national data-protection legislation.

Information may be processed for the purpose of:

  • administering Plans;
  • processing payments;
  • arranging funeral services;
  • arranging burial or cremation;
  • arranging repatriation;
  • providing Will services;
  • providing Celebrant services;
  • providing pet-related services;
  • communicating with clients;
  • maintaining records;
  • complying with legal obligations; and
  • preventing fraud or misuse.

Information may be shared where necessary with appointed Funeral Directors, funeral facilities, crematoria, cemeteries, Celebrants, Will writers, legal professionals, payment providers and other authorised service providers.

28. LOCAL LAW AND FUNERAL REQUIREMENTS

Funeral, burial, cremation and repatriation arrangements are subject to the law and operational requirements of the country where the relevant service takes place.

These may include requirements imposed by:

  • government authorities;
  • civil registries;
  • health authorities;
  • Funeral Directors;
  • tanatorios;
  • casas mortuárias;
  • crematoria;
  • cemeteries;
  • airlines; and
  • other authorised providers.

Where a service cannot reasonably be provided exactly as described because of legal, regulatory or operational requirements, Elysium will seek to provide a reasonable alternative within the scope and value of the Plan, where permitted by law.

29. CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL

Elysium will use reasonable care and skill in arranging the services included within a Plan.

Elysium will not be responsible for delay or inability to provide a service where caused by circumstances beyond our reasonable control, including:

  • changes in law;
  • government requirements;
  • crematorium or cemetery availability;
  • airline restrictions;
  • extreme weather;
  • strikes;
  • civil emergencies;
  • public-health restrictions; or
  • other circumstances outside reasonable control.

Where this occurs, Elysium will seek to provide an appropriate alternative where reasonably possible.

30. CONSUMER RIGHTS

Nothing in these Terms is intended to exclude or restrict mandatory consumer rights applicable in Spain, Portugal, Cyprus, the European Union or elsewhere.

Where applicable law provides rights greater than those stated in these Terms, those rights will apply.

Mandatory legal requirements will prevail over any conflicting provision of these Terms.

Please provide:

  • your name;
  • address;
  • Plan Number;
  • details of the complaint;
  • relevant dates;
  • previous communications; and
  • the outcome you are seeking.

We aim to acknowledge complaints within seven days and will provide an anticipated timescale for resolution or further communication.

Where appropriate, Elysium will provide information regarding the relevant consumer or data-protection authority.

32. APPLICABLE LAW AND JURISDICTION

Elysium will comply with the mandatory laws and consumer-protection requirements applicable to the Plan and the country concerned.

The applicable contractual law and jurisdiction will be identified in the individual Plan Documentation where required.

Nothing in these Terms prevents a consumer from exercising mandatory rights available under the law applicable to them.

33. CHANGES TO THESE TERMS

Elysium may update these Terms where reasonably necessary to reflect changes to:

  • our services;
  • our business;
  • technology;
  • funeral arrangements;
  • legal requirements;
  • regulatory requirements; or
  • operational procedures.

Changes will not retrospectively remove contractual rights already acquired by a Plan Holder where prohibited by law.

The version applicable to an individual Plan will normally be the version supplied when the Plan was created, subject to mandatory legal requirements.

34. ORDER OF PRECEDENCE

The following documents should be read together:

  1. Applicable mandatory law;
  2. Individual Plan Documentation;
  3. these Terms & Conditions; and
  4. any applicable service-specific terms.

Where there is a conflict, mandatory law will prevail.

Where the individual Plan Documentation contains specific terms relating to the Plan purchased, those specific terms will apply to that provision.

35. GENERAL

35.1

Elysium will use reasonable care and skill in arranging the services included within each Plan.

35.2

No verbal representation will alter these contractual terms unless confirmed in writing by an authorised representative of Elysium.

35.3

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

35.4

A failure by Elysium to enforce a provision immediately does not constitute a waiver of that provision.

35.5

The Plan Holder should retain these Terms together with their individual Plan Documentation and other important documents.
