1.5 WHAT DOES ELYSIUM FUNERAL PLANS SL DO?

Elysium Funeral Plans SL is in the business of the creation and sale of pre-paid funeral plans in Spain, Portugal and Cyprus.

1.6 WHAT PLANS DOES ELYSIUM FUNERAL PLANS SELL?

Our current range of funeral plans are made up as follows:

1.6(a) CLARITY – Our Direct Cremation plan which has no provision for either mourners or a religious service of any kind.

1.6(b) TRANQUILITY – Our traditional funeral service incorporating a burial or cremation with the provision for mourners but no provision for any form of religious service.

1.6(c) SERENITY – Our traditional funeral service offering the same elements as a Tranquility but including either a religious or humanist service.

1.6(d) UNITY – Our repatriation service which operates through the whole of the EU.

1. HOW CAN YOU PURCHASE OUR PLANS?

Our Plans can be purchased in one of the following format:

1.7(a) SINGLE One plan either paid in full or monthly.

1.7(b) JOINT – Two plans of the same plan type either paid for in full or monthly.

1.7(c) DUO – Two plans of differing plan type either paid for in full or monthly.

1.7(d) EVOLVE – Single, Joint or DUO plans to assist holders of Funeral Insurance to transfer to Funeral Plans.

1.7 (e) LIVING Any funeral plan incorporating an Elysium Celebrant-led Celebration of Life prior to passing.

2.1 WHAT IS INCLUDED

2.1.1   Unattended cremation at an appointed crematorium.

2.1.2   Cremation fee.

2.1.3    Appointed Funeral Director attending to all the necessary arrangements for the unattended cremation

2.1.4    Collection and transportation of the deceased from a place of residence, a care home, hospital or resting place in  mainland Spain to a mortuary within

mainland Spain.  Please note:  in some cases, Direct Cremations may not be in undertaken at the nearest crematorium to the planholders place of abode.

2.1.5    Preparation and care of the deceased at the allocated mortuary (including full hygienic treatment and removal of  pacemaker, where required).

2.1.6    Supply of a simple coffin – suitable for cremation.

2.1.7    Supply of a simple urn.

2.1.8    Return of ashes directly to the family in Spain.

2.1.9    24-hour bereavement line with English speaking operators.

2.1.10  National & International death certificate.

2.1.11  Cremation certificate to allow ashes to be taken on board an aircraft, where appropriate.

Included: Choice of Privilege Collections.

Option:‘Friend at the End’ Accompaniment Service

‘Friend at the End’ Accompaniment Service has been designed not to breach the rules and regulations surrounding a Direct Cremation but enables a representative to be present at the arrival of the deceased to the crematorium where a poem, reading or silent contemplation will be undertaken as per contracted instructions. Where the representative is positioned and able to carry this out is entirely at the discretion of the Crematorium’s management and as such Elysium cannot be held responsible if this takes place in a format different to what was required.

2.2 WHAT IS NOT INCLUDED

Following the death of the plan holder your Nominated Representative cannot add products or services to your funeral plan. In the unlikely event that they are able to, there will be extra charges that will have to be paid directly to the Elysium Appointed Funeral Director.

2.2.1    Any services for a Funeral Director not appointed by Elysium.

2.2.2    Face to face appointments with the Funeral Director.

2.2.3    Viewing of the deceased.

2.2.4    Dressing of the deceased in personal clothes or inclusion of items within the coffin.

2.2.5    Family attendance at the crematorium.

2.2.6    A service at the crematorium or any costs to host the event of a service including a church service.

2.2.7    Costs for any mortuary storage.

2.2.8    Choice of date, time or location of the cremation.

2.2.9    A wake, including the costs associated with catering for the funeral guests.

2.2.10  Any obituary notices.

2.2.11   Flowers, floral tributes, or any items requested in celebration of the deceased.

2.2.12   Interment of ashes.

2.2.13   Headstone, memorials, plaques or associated costs for erection or maintenance thereof.

2.2.14   Gifts including charitable donations, unless included in the Privilege selection.

2.2.15   Repatriation from outside Spain.

2.2.16  Transfer to or from mainland Spain, the Canary Islands or Balearic Islands.

2.2.17   Audio or visual equipment.

2.2.18  Travel or transport costs.

2.2.19  Any other goods or services not listed in the inclusions section.

3.1 WHAT IS INCLUDED

The Tranquility Funeral Plan provides for the essential products and services provided by the Elysium Appointed Funeral Director for a funeral in Spain, Canary Islands and Balearic Islands. Subject to the terms described here, this plan will cover:

3.1.1   Appointed Funeral Director attending to all the necessary funeral  arrangements prior to and on the day of the funeral.

3.1.2   Appointed Funeral Director providing confidential advice on the certification and registration of the death.

3.1.3   Cremation fee.

3.1.4   Collection and transportation of the deceased from a place of residence, a care home, hospital or resting  place in Spain to the mortuary.

3.1.5    Care and preparation of the deceased at the funeral home (to include full hygienic treatment and removal of pacemaker, where required).

3.1.6   Supply of a simple wood effect coffin – suitable for burial or cremation.

3.1.7   4 days mortuary expenses and use of the Chapel of Rest to allow family and friends to travel to attend the funeral and pay their final respects to the deceased.

3.1.8    Transportation of the deceased to the Funeral Director’s appointed crematorium or chosen cemetery.

3.1.9    National and International death certificates.

3.1.10  24-hour bereavement line with English speaking operators.

3.1.11  Supply of a simple urn if a cremation service chosen.

3.1.12  Cremation certificate to allow ashes to be taken on board an aircraft, where appropriate Included: Choice of Privilege Collections.

3.2 WHAT IS NOT INCLUDED

Following the death of the plan holder should your Nominated Representative elect to add products or services to your funeral there will be extra charges that will have to be paid by your Nominated Representative. Your plan does not include:

3.2.1    Any services for a Funeral Director not appointed by Elysium.

3.2.2    Any costs to host the event of a service including a church service.

3.2.3    A wake, including the costs associated with catering for the funeral congregation/guests.

3.2.4    Obituary notices posted in the media.

3.2.5    Flowers, floral tributes, or any items requested in celebration of the deceased.

3.2.6    Burial plot – a plot of land purchased to be used as a grave.

3.2.7    Headstone, memorials, or associated costs for stonework and erection    thereof.

3.2.8    Gifts, including charitable donations unless included in the Privilege selection.

3.2.9    Cost incurred for the upkeep and maintenance of a memorial.

3.2.10  Any transportation of funeral guests on the day of the funeral.

3.2.11   List of funeral guests who sent flowers and charitable donations.

3.2.12   Hymn cards and order of service.

3.2.13   Audio or visual equipment.

3.2.14   Interment or distribution of ashes.

3.2.15   Repatriation from outside Spain.

3.2.16   Transfer to or from Mainland Spain, the Canary Islands or Balearic Islands.

3.2.17   Chapel of rest for viewing the deceased.

3.2.18   Any other goods or services not listed in the inclusions section.

4.1 WHAT IS INCLUDED

The Serenity Funeral Plan provides all the essential products and services provided by the Elysium Appointed Funeral Director for a funeral in Spain, Canary Islands and Balearic Islands with either a religious or humanist service. This plan will cover:

4.1   Appointed Funeral Director attending to all the necessary funeral arrangements prior to and on the day of the funeral.

4.2   Appointed Funeral Director providing confidential advice on the certification and registration of the death.

4.3   Collection and transportation of the deceased from a place of residence, a care home, hospital or resting place in Spain to the mortuary.

4.4    Care and preparation of the deceased at the funeral home (to include full hygienic treatment and removal of pacemaker, where required).

4.5    Supply of a quality veneered coffin – suitable for burial or cremation.

4.6    Minister or celebrant for funeral service Relevant funeral staff required to conduct the funeral service.

4.7    Cremation fee.

4.8    5 days mortuary expenses and use of the Chapel of Rest to allow family and friends to travel to attend the funeral and pay their final respects to the deceased.

4.9   Transportation of the deceased to the Funeral Director’s appointed cemetery/crematorium.

4.10  National and International death certificate.

4.11   24-hour bereavement line with English speaking operators.

4.12   Small spray of flowers.

4.13   Supply of a simple urn.

4.14   Cremation certificate to allow ashes to be taken on board an aircraft, where appropriate.Included: Choice of Privilege Collections.

4.2 WHAT IS NOT INCLUDED

We have set out below items that are frequently associated with a funeral but are not covered by the Serenity Funeral Plan.  This is not an exhaustive list of products and services. Following the death of the plan holder should your Nominated Representative elect to add products or services to your funeral there will be extra charges that will have to be paid by your Nominated Representative. Your plan does not include:

4.2.1    Any services for a Funeral Director not appointed by Elysium.

4.2.2    Additional venue costs to host the event of a service including a church service.

4.2.3    A wake, including the costs associated with catering for the funeral congregation/guests.

4.2.4    Obituary notices posted in the media.

4.2.5    Extra flowers, floral tributes, or any items requested in celebration of the Deceased.

4.2.6    Burial plot – a plot of land purchased to be used as a grave

4.2.7    Headstone, memorials, or associated costs for stonework and erection thereof.

4.2.8    Gifts, including charitable donations unless included in the Privilege Selection.

4.2.9    Cost incurred for the upkeep and maintenance of a memorial

4.2.10  Any transportation of funeral guests on the day of the funeral

4.2.11  List of funeral guests who sent flowers and charitable donations

4.2.12  Use of chapel of rest for viewing the deceased

4.2.13  Hymn cards and order of service

4.2.14  Audio or visual equipment

4.2.15  Interment or distribution of ashes

4.2.16  Repatriation to or from Spain

4.2.17  Transfer to or from mainland Spain, Canary Islands and Balearic Islands

4.2.18  Any other goods or services not listed in the inclusions section

5.1 WHAT IS INCLUDED

The Unity Repatriation Plan provides all the elements as laid out in the relevant plan documentation. The essential products and services provided by the  Elysium Appointed Funeral Director for a repatriation from mainland Spain to the UK or any member state in the EU. Subject to the terms described here, this plan will cover:

5.1.1    Attending to all legal and administrative formalities required for repatriation from mainland Spain to the UK or any EU member state liaising with Spanish and Elysium Appointed Funeral Director in UK/EU member state with supervision throughout the process.

5.1.2   Elysium Appointed Funeral Director in Spain attending to all the necessary funeral arrangements prior to and up to delivery of the coffin to the airport.

          

5.1.3   Elysium Appointed Funeral Director in UK / EU Member state attending to all the necessary funeral arrangements from receipt of the coffin at the airport to the day of the funeral.

5.1.4    Elysium Appointed Funeral Directors in Spain and in the receiving country providing confidential advice on  the certification and registration of the death.

5.1.5    Collection and transportation of the deceased from a place of residence, a care home, hospital, or resting place in mainland Spain to the mortuary in mainland Spain.

5.1.6    Care and preparation of the deceased for transportation (to include full hygienic treatment and removal of pacemaker, where required).

5.1.7    4 days mortuary expenses in Spain.

5.1.8    Supply of a coffin suitable for transportation.

5.1.9    Transportation of the deceased to the airport in Spain.

5.1.10   Flight for the deceased to the Receiving Country.

5.1.11   Receiving the deceased in the Receiving Country by the Elysium Appointed Funeral Director. Should the Next of Kin or family members authorise another Funeral Director, the contribution  of up to €2,000 (or GBP equivalent) to the funeral in the Receiving country shall be considered VOID.

5.1.12  The contribution of up to €2,000 (or GBP equivalent) may be increased yearly at the discretion of the Directors of Elysium Funeral Plans SL. Plan holders affected by such an increase will be notified directly. The contribution is put towards the cost of a basic funeral service as specified in the Receiving Country.

5.1.13  If the cost of a funeral service in the Receiving Country exceeds €2,000 (or GBP equivalent) the responsibility of paying for the remainder of the funeral is the responsibility of the Next of Kin.

            

5.1.14  If the cost of the funeral service in the Receiving Country does not exceed €2000 (of GBP equivalent), no further funds will not be made available.

5.1.15  Elysium Funeral Plans will settle the bill, or its portion of the bill directly with its Nominated Funeral Director in the Receiving Country.

5.1.16  24-hour bereavement line with English speaking operators.

5.2 WHAT IS NOT INCLUDED

We have set out below items that are frequently associated with a funeral but are not covered by the Repatriation Burial Funeral Plan (Spain). This is not an exhaustive list of products and services. Following the death of the plan holder should your Nominated Representative elect to add products or services to your funeral there will be extra charges that will have to be paid by your Nominated Representative. Your plan does not include:

5.2.1    Any services for a Funeral Director not appointed by Elysium Funeral plans.

5.2.2    Additional venue costs to host the event of a service excluding a church service or similar, specific to the plan holder’s religion.

5.2.3    A wake, including the costs associated with catering for the funeral congregation and/or guests.

5.2.4    Obituary notices posted in the media, flowers, floral tributes, or any items requested in celebration of the deceased.

5.2.5    Burial plot – a plot of land purchased to be used as a grave.

5.2.6    Transfer from overseas to mainland Spain, the Canary Islands or Balearic Islands.

5.2.7    Headstone, memorials, or associated costs for stonework and erection thereof.

5.2.8    Gifts, including charitable donations, except those choosing.

5.2.9    Cost incurred for the upkeep and maintenance of a memorial.

5.2.10  List of funeral guests who sent flowers and charitable donations.

5.2.11  Use of chapel of rest for viewing the deceased.

5.2.12  Hymn cards and order of service.

5.2.13  Audio or visual equipment

5.2.14  Any extra airport handling fees not included in the flight

5.2.15  Any other goods or services not listed in the inclusions section

6.1  JOINT PLANS – A Joint Plan is created by purchasing two plans of the same name. If the plans making up the Joint Plans are purchased at the same time, there will be a discount of  €100 on the Joint price.

The Terms and Conditions pertaining to the Joint Plan will exactly mirror the Terms and Conditions of the single Plan on which it is based.

Plans purchased will be entitled to a Privilege Collection as shown in Clause 7 Privilege Collection Overview and detailed in clauses 7.1 to 7.3 inclusive and explained in detailed in Clause 8 in its entirety.

For specific terms relating to the cancellation of a Joint Plan please see clause 12 on Cancellation.

6.2   DUO PLANS – A DUO Plan is created by purchasing two plans of differing type. If the plans making up the DUO Plans are purchased at the same time, there will be a discount of €100.

The Terms and Conditions pertaining to the DUO Plan will exactly mirror the Terms and Conditions of the single Plans on which it is based.

Plans purchased will be entitled to a Privilege Collection as shown in Clause 7 Privilege Collection Overview and detailed in clauses 7.1 to 7.3 inclusive and explained in detailed in Clause 8 in its entirety.

For specific Terms relating to the cancellation of a DUO Plan please see clause 12 on Cancellation.

6.3  FAMILY PLANS – A Family plan is designed to be a multi-generational plan, covering 2 or three generations of the same family. To be Founder Members of a Family plan a Joint or DUO Plan must be purchased in full. Once this is in place, additional plan holders can be added to the Family Plan each receiving a €100 discount on the price of their plan.

The Terms and Conditions pertaining to the DUO Plan will exactly mirror the Terms and Conditions of the single Plans on which it is based.

Plans purchased will be entitled to a Privilege Collection as shown in Clause 7 Privilege Collection Overview and detailed in clauses 7.1 to 7.3 inclusive and explained in detailed in Clause 8 in its entirety.

For specific Terms relating to the cancellation of a DUO Plan please see clause 12 on Cancellation.

6.4   CHILDREN’S PLANS – Elysium Funeral Plans provide a FREE Children’s Plan for a related child (under 18) for every full paying plan purchased regardless of Plan type. A Joint Plan, a DUO Plan or Founding Family Plans allow for two FREE Children’s Plans being created.

The FREE Children’s Plan offered is a Clarity Funeral Plan which is a Direct Cremation. It is offered with NO Privileges and automatically cancels when the Plan Holder reaches their 18th birthday.

An upgraded plan, either a Tranquility Plan or a Serenity Plan can be purchased at the Children’s Discount Rate. The Children’s Discount Rate is the current Price of a Tranquility Plan or Serenity Plan less the cost of a Clarity Plan.

Whichever Plan is taken, it is offered with NO Privileges and automatically cancels when the Plan Holder reaches their 18th birthday.

The Children’s Plan Holder can take out an Adult Plan with a €200 discount.

The Children’s Plan CANNOT be transferred.

If the adult plan against which the Children’s Plan is created is either cancelled or called upon, the Children’s Plan will automatically be cancelled.

6.5   EVOLVE PLAN – The above Plan has been designed to replace funeral insurance and allow Evolve plan holders to benefit from a fixed term and the knowledge that there is nothing further to pay for.

The Evolve Plan can be created from any Elysium Funeral Plan.

The Evolve Plan is designed in such a way that the first year’s monthly premiums are equal to the monthly premiums of the replaced Funeral Insurance policy. Premiums then increase year on year till in year 5 the monthly premiums paid equal those who are purchasing the plan outside the Evolve Structure.

6.6   LIVING PLAN – A living Plan is any Elysium Funeral Plan with the additional services of an Elysium Celebrant who will lead and guide a day /weekend of Celebration of Life with the Plan Holder and their family and friends prior to passing.

On passing, the Elysium Funeral Plan will take place.

Terms are as per the nominated funeral plan and terms regarding the Elysium celebrant can be found at www.elysiumcelebrant.com.

7.  Elysium Privilege Collections Overview

7.1 FULL PAYERS RECEIVE ‘PREMIER PRIVILEGES’:

30 Day Consideration Period.

14-Year Refund Commitment.

10-Year Legacy Refund Commitment.

Free Children’s Plans.

Free Will.

€50 Charity Donation for each plan created.

A tree planted for every plan created and on each anniversary.

Eligible for “Transfer-In” Refund.

€100 discount for Joint Plans.

€100 discount for DUO Plans

Eligible for entry into the ‘12 Draws of Good Luck’ New Years Eve Draw.

Eligible to be included in a Family Plan, a Joint Plan and a DUO Plan.

7.2 MONTHLY PAYERS UP TO 60 MONTHS RECEIVE  ‘CLASSIC PRIVILEGES’:

30 Day Consideration Period.

14-Year Refund Commitment.

€25 Charity Donation for each plan created.

A tree planted for every plan created.

Eligible for entry into the ‘12 Draws of Good Luck’ New Years Eve Draw once their plan(s) is/are fully paid up. They will be entered into the months draw for the month their final payment is received.

7.3 MONTHLY PAYERS FROM 61-120 MONTHS RECEIVE ‘STANDARD PRIVILEGES’:

30 Day Consideration Period.

14-Year Refund Commitment.

8.  THE PRIVILEGES COLLECTIONS IN DETAIL

8.1  30 DAY CONSIDERATION PERIOD (All Plans) – Each Plan holder has a full 30 days from the date of creating a plan to consider if it the right plan for them. If they feel it isn’t they simply complete the cancellation form and return it to Elysium Funeral Plans within this 30 day period and they will receive a full refund.

8.2   14-YEAR REFUND COMMITMENT (All Plans) – If the plan has not been called upon within 14 years from the plan creation date, Elysium Funeral Plans will refund the plan fee in full and assume responsibility for paying for the funeral at its time of need.

If the Plan purchased was JOINT or DUO Plan and one has been called upon, the refund will be for the plan that has not been called upon

Please Note: The 14-Year Refund Commitment does not start on monthly payment plans until the final monthly payment has been received from the plan holder.

8.3  10-YEAR LEGACY REFUND COMMITMENT (Full Paying Plans Only) Should you pass after the 10th Anniversary but before the 14th Anniversary, we will refund to  your Beneficiary/Beneficiaries the full funeral plan when the 14th Anniversary is reached. It is a requirement that the Beneficiary/Beneficiaries has/have reached the age of 18. If the Beneficiary/Beneficiaries has/have not reached the age of 18, the refund will take place once the Beneficiary/Beneficiaries have all reached the age of 18.

Please Note: The funds will not be paid to a parent, step-parent, grandparent, step- grandparent or any other relative under any circumstances.

8.4  FREE CHILDREN’S PLANS (Full Paying Plans Only)For every full paying client that purchases  any Elysium Plan,  we will supply one (1) Children’s Basic Clarity Plan to a member of the family aged under 18. The Children’s Clarity Plans come with NO additional Privileges.

The following terms exist for such a plan:

  1. The plans can only be used for children, stepchildren, grandchildren or step-grandchildren.
  1. Evidence of the relationship has to be provided and accepted by Elysium Funeral Plan Compliance before the Children’s Plans can be created.
  1. The Adult Plans to which the Child’s Clarity Plans are attached must have been created for a minimum of 6 months before the Child’s Clarity Plans can be created.
  1. Should the Adult Plan to which the Children’s Clarity Plan is attached be either cancelled for whatever reason or called upon, the Child’s Plan will automatically be cancelled and will not be renewed.
  1. Should a Child’s Clarity Plan not be acceptable, it is possible to upgrade the Children’s plans to either a Tranquility Plan or a Serenity Plan by paying the difference. These payments would have to be in full and these plans also would carry NO privileges.
  1. The Children’s Plan automatically cancel on the 18th Birthday of the nominated child. They will then be invited to join the Family Plan, receiving the standard Family discount and a further discount reflecting that they held Children’s Plans.
  1. Further children can be covered at the discounted rate as specified in our Plan details along with the same terms.

8.5   FREE WILL (Full Paying Plans Only) – For every Full Paying Plan created, Elysium Funeral Plans will include a professionally written Standard Will, notarised and registered as is standard practise in Spain.  The following Terms exist for Will writing:

  1. The Will writer, nominated by Elysium Funeral Plans will contact the Plan Holder, within 30 days of the Consideration Period ending.
  1. The choice of the Will writer is decided on by Elysium Funeral Plans SL and is based on their professionalism and experience in writing Standard Wills.
  1. The Will writer will discuss the Plan Holders requirements and wherever possible, will write the Will as a Standard Will.
  1. If a Standard Will is not suitable for the Plan Holder, for whatever reason , such as large value property and equity portfolios, this will be considered outside the remit of a Standard Will and the Will writer will advise the Plan Holder what they will actually require. If the Plan Holder decides to take up the offer of the Will Writer writing a more Complex Will the difference in price between a Standard Will and a Complex will is the responsibility of the Plan Holder, with no exceptions.
  1. If the Plan Holder decides they do not require a Will for whatever reason, there is no alternative offering or discount offered in its place.
  1. If the Plan Holder cancels their plan within the first 5 years of its creation, Elysium Funeral Plans SL will also withhold the cost of the Will from any refund due.

8.6   €50 CHARITY DONATION (Full Paying Plans Only) We work with a select number of charities who rely on public donations to continue with their work in the community.

The Plan Holder will have the opportunity to choose from that list for their donation to be sent to.

The donation will be sent 60 days after the end of the Consultation period – 90 days after the creation of the plan to ensure that the plan is firmly established before the donation is made.

8.7   €25 CHARITY DONATION (Monthly Paying Plans up to 60 months) – We work with a select number of charities who rely on public donations to continue with their work in the community.

The Plan Holder will have the opportunity to choose from that list for their donation to be sent to.

The donation will be sent 60 days after the end of the Consideration Period – 90 days after the creation of the plan to ensure that the plan is firmly established before the donation is made.

Please Note: We do not include a charity donation with plans that extend their term over 60 months.

8.8   A TREE PLANTED (All Plans up to 60 months) – We are committed to making sure the planet remains healthy, so future generations are able to enjoy it. We are proud to have partnered with JUST ONE TREE to ensure we are actively involved in reforestation programmes. We have committed to plant one tree on the creation of each plan. The instruction is given, and payment made, 60 days after the end of the Consideration Period – 90 days after the creation of the plan to ensure that the plan is firmly established before the donation is made. If the Plan is cancelled before the instruction is given to JUST ONE TREE we will unfortunately have to cancel the tree planting instruction.

8.9   A TREE PLANTED ON EVERY ANNIVERSARY (Full paying Plans only) In addition to planting one tree on the creation of a plan, we have committed to planting a tree with JUST ONE TREE on the anniversary of the plans creation until the plan is called upon. The instruction is given, and payment made, 60 days after the end of the Consideration Period – 90 days after the creation of the plan to ensure that the plan is firmly established before the donation is made. If the Plan is cancelled at any time, the tree planting will also cease.

Please Note: We do not include a free tree planted with plans that extend their term over 60 months.

8.10   ELIGIBLE FOR ‘TRANSFER-IN’ REFUND (Full Paying Plans) – Every new plan created and paid for in full, where the plan holder has cancelled their current/previous plan from another Funeral Plan Provider, we will refund the cancellation fee in full 60 days after the end of the Consideration Period – 90 days after the Plan has been created to ensure the new Plan is firmly established before the refund is made.

Please Note: We will require to see original letters outlining the cancellation fee and proof that they have refunded the funeral plan and have deducted their cancellation fee. We will pay the lower of that figure or what is shown on the company website or displayed in their company literature.

8.11   €100 DISCOUNT FOR JOINT PLANS (Full paying Plans) Each Joint Plan, that is paid in full, will receive a €100 discount on the price, compared to the individual purchase price of two singles. The following terms apply:

  1. The Joint Plans are from the same Plan type – Clarity, Tranquility or Serenity.
  1. The Plans must be bought at the same time and paid for in full OR Upgrade from a monthly paying Plan to a Full paying Plan within 90 days of the plans’ creation.
  1. For the avoidance of doubt, should a plan be called upon before the eligibility dates for the Refund Commitments, the surviving plan that has become eligible for a Commitment Refund, will be refunded less the €100 regardless of which plan was called upon.

8.12   €100 DISCOUNT FOR DUO PLANS (Full paying Plans) – Each DUO Plan that is paid in full, will receive a €100 discount on the price, compared to the individual purchase price of two singles. The following terms apply:

  1. The DUO Plans are from any combination of Plan type – Clarity, Tranquility or Serenity.
  1. The Plans must be bought at the same time and paid for in full OR Upgrade from a monthly paying Plan to a Full paying Plan within 90 days of the plans creation.
  1. For the avoidance of doubt, should a plan be called upon before the eligibility dates for the Refund Commitments, the surviving plan that has become eligible for a Commitment Refund, will be refunded less the €100 regardless of which plan was called upon.

Please Note: We do not include a Joint or DUO €100 discount for Unity Repatriation Plans.

8.14   ELIGIBILITY FOR ENTRY INTO THE ’12 DRAWS OF GOOD LUCK’ NEW YEARS EVE DRAW (Full Paying Plans) – Full Paying Plans will be entered into the ’12 Draws of Good Luck’  Draw which take place on New Years Eve each year. Your plan will be entered into the draw for the month that the plan was created. If your Plan number is the winning plan for that month, you will receive your plan fee in full at the end of the month in question in the forthcoming year. For example:

  • You created a plan in July 2024 and paid in Full.
  • Your plan is entered into the July Draw.
  • If successful, you will receive your plan fee in full within 30 days of the end of July 2025.
  • Your plan will be entered into the draw every year until it is either drawn as a winner, receives a refund on the 14th Anniversary or is called upon.

No variation of this will be accepted.

Winning Plan Holders will be required to take part in marketing photographs which we reserve the right to place onto our social media channels and website.

8.15   ELIGIBILITY FOR ENTRY INTO THE ’12 DRAWS OF GOOD LUCK’ NEW

          YEARS EVE DRAW (Monthly Paying Plans) – Monthly Plans will be entered into the ’12 Draws of Good Luck’ which takes place on New Years Eve each year once we have received their final payment. If your Plan number is the winning plan for that month, you will receive your plan fee in full at the end of the month in question in the forthcoming year. For example:

  • You created a plan in July 2022 and paid over 24 months.
  • Your plan is entered into the July 2024 draw as that was the date your last paid was received.
  • If successful, you will receive your plan fee in full within 30 days of the end of July 2025.
  • Your plan will be entered into the draw every year until it is either drawn as a winner, receives a refund on the 14th Anniversary or is called upon.

No variation of this will be accepted.

Winning Plan Holders will be required to take part in marketing photographs which we reserve the right to place onto our social media channels and website.

Please Note: We will automatically remove the plan from the ’12 Draws of Good Luck’ should the following occur:

  1. The plan has already won in previous years.
  2. The plan has been cancelled.
  3. The Monthly plan is in arrears at the time of the draw.

8.16   TRANSFERRING YOUR PLAN TO ANOTHER PERSON (Full Payment Plans) – After then plan has been active for 5 years, you may transfer the benefits of the plan to a family member or friend who has predeceased you.

8.17   TRANSFERRING YOUR PLAN TO ANOTHER PERSON (Monthly Payment Plans) –  After the plan has been active for 5 years after the final payment, you may transfer the benefits of the plan to a family member or friend who has predeceased you.

Caveats:

  1. If you transfer the plan, your plan will be removed from the ’12 draws of luck ‘ New Years draw, regardless if the plan was a Single, Joint or DUO Plan.
  1. Joint or DUO Plans: the remaining plan must remain in the name of one of the original plan holders and cannot be transferred.
  1. We will accept no responsibility for any family disagreement, argument or dispute regarding transferring the plan.
  1. We will not enter into any dialogue with anybody regarding this matter and will only communicate with our original plan holder.
  1. If the new plan holders Next of Kin or their families require any additional services, it will be their responsibility to arrange and pay for them directly with the Nominated Funeral Director. Elysium Funeral Plans will not be liable for additional third-party costs.
  1. If the original Plan included the services of an Elysium Celebrant to conduct the service and if that service is still required, there will be an Administration fee of €100 to alter the service to reflect the new plan holder.
  1. If the Next of Kin does not require the services of the Elysium Celebrant, there will be no repayment for this element of the plan.

Should you wish to change the beneficiary of a single, Joint of DUO Plan, please notify client are@elysiumfuneralplans.com/ at your earliest convenience.

9       COMMITMENT REFUNDS

9.1   14-YEAR REFUND COMMITMENT CLAIM PROCESS

The following is the process that should be followed to enable Plan holders, eligible for a refund under the 14-Year Refund Commitment, to receive their refund in a timely manner:

  1. Please keep the original Refund Certificate safe as soon as it is received. We recommend keeping it in the Client Portal, where it was originally delivered.
  1. If you requested paper copies of all documents, please ensure the documents are kept safely with other high value paperwork, such as deeds and Wills. We would recommend keeping them in storage at your bank or with a lawyer.
  1. 30 days before the Term expires, we will write and remind you. It is important that update us with changes of address as they happen. If we are not advised of changes of address at the appropriate time, Compliance will need to see proof for security reasons which will slow down the whole process.
  1. Please send the original Refund Certificate via recorded mail to the Registered Address of Elysium Funeral Plans SL as detailed at the Commercial Registry at the time.
  1. Once the original Refund Certificate has been received, there are several security checks that we carry out, which may include calling you and asking some questions.
  1. If the Refund Certificate has been left in the client portal for safe keeping, there is no need to send in a copy. Once Compliance as completed its Due Diligence, the refund will be released.

9.2   10-YEAR LEGACY REFUND COMMITMENT CLAIM PROCESS

The following is the process that should be followed to enable Beneficiaries eligible to receive the Legacy Refund under the 10-Year Legacy Refund Commitment, to receive the refund in a timely manner:

  1. Please keep the original Refund Certificate safe as soon as it is received. We recommend keeping it in the Client Portal, where it was originally delivered.
  1. If you requested paper copies of all documents, please ensure the documents are kept safely with other high value paperwork, such as deeds and Wills. We would recommend keeping them in storage at your bank or with a lawyer.
  1. 30 days before the Term expires, we will write to the Beneficiary and remind them that are entitled to receive the Plan Fee Refund. It is important that  they can update us with changes of address as they happen. If we are not advised of changes of address at the appropriate time, Compliance will need to see proof for security reasons which will slow down the whole process.
  1. Please send the original Refund Certificate via recorded mail to the Registered Address of Elysium Funeral Plans SL as detailed at the Commercial Registry at the time of redemption.
  1. Once the original Refund Certificate has been received, there are several security checks that we carry out, which may include calling you and asking some questions.
  1. If the Refund Certificate has been left in the client portal for safe keeping, there is no need to send in a copy. Once Compliance as completed its Due Diligence, the refund will be released.

10.     PAYMENT

10.1   PAYMENT METHODS – There are a number of ways to pay for your Elysium Funeral Plan:

  1. In full, either by debit or credit using our processing systems, either directly from our website or by calling us.
  1. By Bank transfer to our account in Banco Sabadell. Please note that transfers from UK bank accounts may incur charges so it is better to transfer from an account with an EU IBAN.
  1. Monthly up to 10 years (120 months) interest free via either Continuous Card Authority or Sepa Direct Debit

If you decide to pay via a monthly payment plan, please note the minimum deposits we accept are:

Single Plans: €250

Joint and DUO Plans: €500

Please contact the office should you wish to pay a higher deposit to reduce your monthly payments.

By creating an Elysium Funeral Plan, you are entitled to certain Privileges that are detailed in Point 7 above.

10.2   MISSED PAYMENTS – In the event of a missed payment, we will write to you to inform you of the situation and we will endeavour to apply for the payment again. If we are unable to collect the payment a second time, we will seek payment from the plan holder via an alternative method.

Should the plan monthly payments fall two months into arrears, we will suspend the plan till payments have been brought up to date.  During suspension should the plan holder pass away we will cancel the plan and charge a cancellation charge and refund the remaining monies to the Next of Kin. We will be under no obligation to provide the service due to the fact that the plan holder was in default of contractual monthly payments at the time of passing.

Should the Plan fall into three months arrears we will write to the plan holder giving them 7 days to bring the account into good standing. Failure to do so,  for whatever reason, will result in Elysium Funeral Plans cancelling the plan, charging the cancellation fee and refunding remaining monies to the Plan holder. At the point of cancellation, we will be under no obligation to provide the service due to the fact that the plan holder was in default of contractual monthly payments.

10.3  INCOMPLETE PLANS When a plan has an outstanding balance at the time of need, the Next of Kin or other family members will have to settle the account prior to the contracted funeral plan being effected. If the payment is not received we will cancel the plan and refund the monies, less our standard cancellation fee and any outstanding Funeral Directors costs, such as mortuary costs, directly to the Next of Kin. At the point of cancellation, we will be under no obligation to provide the service due to the fact that the outstanding plan costs have not been met by either the Next of Kin or other family members. holder was in default of contractual monthly payments.

11.   PROTECTION OF DATA

In Spain, the protection of data and the computer systems that manage said data are regulated by the ‘Ley Orgánica de Protección de Datos’ , the ‘Organic Law on Data Protection ‘, known as LOPD. We hold LOPD Accreditation and a copy of our LOPD Accreditation is available on request.

As a Spanish Registered Company that processes personal data, we are governed by seven (7)  protection and accountability principles of data protection enshrined in EU GDPR Legislation of which LOPD is party to. Those 7 key points are:

  1. Lawfulness, fairness and transparency — Processing must be lawful, fair, and transparent to the data subject.

Elysium Funeral Plans will always process data on its clients in a fair and open manner, but with security and privacy always at the forefront of everything we do.

  1. Purpose limitation — You must process data for the legitimate purposes specified explicitly to the data subject when you collected it.

Elysium Funeral Plans will only collect data on plan holders and perspective plan holders around their interest in our range of Pre-paid Funeral Plans and ancillary offerings.

  1. Data minimization — You should collect and process only as much data as absolutely necessary for the purposes specified.

Elysium Funeral Plans will only collect necessary data to enable us to fulfil our obligations to our plan holders, their next of kin and loved ones.

  1. Accuracy — You must keep personal data accurate and up to date.

Elysium Funeral Plans strives to maintain accurate information on client’s data as up to date as possible with regular reviews of our internal systems and cross-referencing data by Compliance.

  1. Storage limitation — You may only store personally identifying data for as long as necessary for the specified purpose.

Elysium Funeral Plans will only store personally identifiable data for the duration of the plan holder’s contract with us and in accordance with Spanish Corporate and Tax laws.

  1. Integrity and confidentiality — Processing must be done in such a way as to ensure appropriate security, integrity, and confidentiality (e.g. by using encryption).

Elysium Funeral Plans Holds all data on secure servers and abides by all relevant GDPR rules and regulations. Elysium Funeral Plans uses multi-layer security with all its in-house computer systems ensuring no unauthorised access open to our plan holder’s data.

  1. Accountability — The data controller is responsible for being able to demonstrate GDPR compliance with all of these principles.

The Data Controller, along with the Head of Compliance review the above on a quarterly basis and should it be possible to improve on any point, any improvement is introduced as soon as possible and rigorously tested and  verified on a regular basis.

12    CANCELLATION

12.1  INSIDE THE 30-DAY CONSIDERATION PERIOD – The following are acceptable methods of cancellation:

  1. Via Email to clientcare@elysiumfuneralplans.com/ stating your name, address, date of birth and Plan Number. It would help us to improve our service if you could advise us why you decided to cancel but providing this information is entirely optional.
  1. Via mail, by signing and completing the Cancellation Form and sending it to Client Care, Elysium Funeral Plans SL, C/Carlos Cervera 14,Bajo 46006 Valencia, Spain

    

  1. Please send the Cancellation Form via Recorded Post. It would help us to improve our services if you could advise us why you decided to cancel but providing this information is entirely optional.

You will receive a full refund within 72 hours. The refund will be to the same medium that was used to purchase the plan. Under no circumstances will we send the refund to a third-party bank account or credit a third-party credit or debit card.

Please Note: You have thirty (30) days with the day of creating the plan taken as day one (1) of the 30-day Consideration Period.

12.2  OUTSIDE THE 30-DAY CONSIDERATION PERIOD – The following are acceptable methods of cancellation:

  1. Via Email to clientcare@elysiumfuneralplans.com/, stating your name, address, date of birth and Plan Number. It would help us to improve our service if you could advise us why you decided to cancel but providing this information is entirely optional.
  1. Via mail, by signing and completing the Cancellation Form and sending it to Elysium Funeral Plans SL, C/Carlos Cervera 14,Bajo 46006 Valencia, Spain.
  1. Again, it would help us to improve our service if you could advise us why you decided to cancel but providing this information is entirely optional.

Your refund will be released to you within 14 days of us receiving your cancellation request. The reason for the longer timescale is that we have to remove your funds from investments in such a way that it does not undermine other plan holder’s positions and that their investments are protected. We charge a €295 cancellation fee, which will be deducted from funds before they are released back to you.

If you have benefited from the free Will and cancel within 5 years, we will deduct the price of the Will as well as the cancellation fee. After 5 years this is waivered, although the cancellation fee is still charged.

The refund will be to the same medium that was used to purchase the plan. Under no circumstances will we send the refund to a third-party bank account or credit a third-party credit or debit card proof has been sent confirming and evidencing a change of bank.

13.   COMPLAINTS

We believe that Elysium Funeral Plans offer tremendous value for money and that our service matches that it terms of professionalism and integrity.

We will acknowledge your complaint within 7 days and at that time, provide you an anticipated date for being either able to resolve your complaint or, if we are unable to do that, we will update you with revised timescale.

14.   Applicable Laws

European Law applies to all products and services supplied by Elysium Funeral Plans SL, in particular the EC Consumer Rights Directive, against which our plan contracts and Terms and Conditions operate.
