Disse vilkårene og betingelsene regulerer kjøp og levering av forhåndsbetalte begravelsesplaner og tilhørende tjenester som tilbys av Elysium Funeral Plans SL (“Elysium”, “vi”, “oss” eller “vår”).
Ved å tegne en Elysium-begravelsesplan godtar forsikringstakeren (“du” eller “din”) disse vilkårene og betingelsene samt den individuelle planbeskrivelsen utstedt av Elysium.
Disse vilkårene gjelder for forsikringsavtaler inngått i Spania, Portugal og Kypros, alltid under forutsetning av at de ufravikelige lovene og forbrukerbeskyttelseskravene som gjelder i det aktuelle landet overholdes.

Elysium tilbyr forhåndsbetalte begravelsesavtaler og tilhørende begravelsestjenester til kvalifiserte kunder i Spania, Portugal og Kypros.
Begravelsestjenestene organiseres gjennom Elysium og dets utpekte begravelsesbyråer, begravelsesfagfolk og andre autoriserte tjenesteleverandører.

En hjemtransportplan som omfatter spesifiserte hjemtransporttjenester fra Spania, Portugal eller Kypros til et kvalifisert mottakerland, i henhold til den enkelte planens dokumentasjon og gjeldende lovgivning.
En ordning som omfatter en livsfeiring ledet av en Elysium-seremonimester før forsikringstakerens død.
Bestemmelsene om begravelse etter dødsfall reguleres fortsatt av den underliggende begravelsesordningen.
Elysium Assist er tilgjengelig for nye kunder som er 75 år eller eldre og som oppfyller Elysiums gjeldende krav til kvalifisering på kjøpstidspunktet.
Eksisterende Elysium-abonnenter kan ikke nedgradere et eksisterende abonnement til Elysium Assist.
Elysium Assist er kun tilgjengelig når beløpet er betalt i sin helhet.
Det er ikke mulig å betale månedlig eller gjennom avbetalingsordning.
Den nåværende annonserte prisen for Elysium Assist er €1,800.
Den gjeldende prisen vil bli bekreftet i den enkelte planbeskrivelsen.
Elysium Assist tilbyr en enkel ordning for direkte kremering.
Kun de varene og tjenestene som uttrykkelig er angitt i dokumentasjonen for Elysium Assist-planen, er inkludert.

The Unity Plan provides specified repatriation services from Spain, Portugal or Cyprus to an eligible receiving country.
The receiving country and scope of repatriation will be confirmed in the individual Plan Documentation.
Subject to the individual Plan, local availability and applicable law, Unity may include:
If the Next of Kin chooses a Funeral Director other than the Elysium-appointed Funeral Director in the receiving country, any contribution specified in the Plan may become void.
Where a contribution is available, it is limited to the amount stated in the Plan Documentation.
Unless expressly included, Unity does not include:
The Elysium Non-Resident Plan is designed for individuals who are not resident in Spain, Portugal or Cyprus, but who own property, spend time in or regularly visit one or more of these countries.
The Plan allows the Plan Holder to secure an agreed funeral-plan price while retaining flexibility should they ultimately die outside the covered countries.
A €500 deposit is payable to secure the agreed Plan price.
The agreed price will be confirmed in the individual Plan Documentation.
If the Plan Holder dies in Spain, Portugal or Cyprus, Elysium will arrange the funeral in accordance with the selected Plan and applicable Plan Documentation.
If the Plan Holder dies outside Spain, Portugal or Cyprus, the Non-Resident Plan does not provide for Elysium to arrange or pay for a funeral in that country.
Subject to the conditions of the Plan, the €500 deposit will be returned to the Next of Kin less a €100 administration fee.
The amount refundable will therefore be €400.
The €100 administration fee covers administration associated with closing the Non-Resident Plan and processing the applicable refund.
The administration fee is non-refundable.
Elysium does not arrange, manage, fund or accept responsibility for funeral services taking place outside Spain, Portugal or Cyprus under the Non-Resident Plan.
The Next of Kin or family is responsible for making any funeral arrangements in the country where the death occurs.
The Elysium Non-Resident Plan does not qualify for any Elysium Privilege Collection.

The Non-Resident Plan does not include reimbursement of cancellation, administration or other charges imposed by another funeral-plan provider unless expressly agreed in writing.
The Plan Holder should notify Elysium if they become resident in Spain, Portugal or Cyprus.
Elysium may review the Plan and confirm whether an alternative Plan is more appropriate.
A Family Plan provides funeral-plan arrangements for eligible members of the same family.
The qualifying Founder Plans must be purchased in full unless otherwise stated in the Family Plan Documentation.
Additional eligible family members may be added subject to the applicable Family Plan terms and pricing.
Elysium may provide one free Children’s Clarity Plan for an eligible child under 18 for each qualifying full-paying adult Plan.
The Children’s Plan:
Eligible relationships may include children, stepchildren, grandchildren and step-grandchildren.
Evidence of the relationship may be required.
The qualifying adult Plan must remain active.
If the qualifying adult Plan is cancelled or called upon, the Children’s Plan will cease.
Where available, the Children’s Plan may be upgraded to Tranquility or Serenity by paying the applicable difference.
An upgraded Children’s Plan does not automatically qualify for Privileges.
A Living Plan incorporates an Elysium Celebrant-led Celebration of Life before the Plan Holder’s death.
The Celebration of Life may take place over a day or weekend as agreed with the Plan Holder and Celebrant.
The funeral provision following death remains governed by the underlying Elysium Funeral Plan.
Additional Celebrant terms may apply.
Privilege Collections apply only to Plans expressly identified as eligible.
Eligible full-paying Plans may receive:
Elysium Assist and the Non-Resident Plan are excluded from Privilege Collections.
Eligible monthly Plans paid over up to 60 months may receive:
Eligible monthly Plans paid over 61–120 months receive:
Every eligible Plan Holder has 21 days from the date the Plan is created to consider whether the Plan is suitable.
The date the Plan is created is Day 1.
Cancellation should be requested in writing.
Subject to applicable law and completion of the cancellation process, eligible payments will be refunded.
Nothing in these Terms limits any statutory cancellation or withdrawal rights that cannot legally be excluded.
Where applicable, if a qualifying Plan has not been called upon within 14 years from the applicable commencement date, Elysium will refund the Plan Fee in accordance with the Refund Commitment and assume responsibility for the funeral provision at the time of need, subject to the Plan Documentation and applicable law.
For monthly Plans, the 14-Year Refund Commitment begins when the Plan has been fully paid unless the Plan Documentation states otherwise.
For qualifying full-paying Plans, where the Plan Holder dies after the tenth anniversary but before the fourteenth anniversary, Elysium will refund the qualifying Plan Fee to the named Beneficiary or Beneficiaries when the fourteenth anniversary is reached, subject to the applicable terms.
Beneficiaries must satisfy Elysium’s identity and verification requirements.
Where a Beneficiary is under 18, payment will be deferred until the applicable legal age or otherwise dealt with in accordance with applicable law.
Eligible full-paying Plan Holders may receive a professionally prepared Standard Will through an Elysium-appointed Will writer or legal professional.
The Will service is subject to the professional and legal requirements applicable in the relevant country.
Additional legal work, complex Wills, notarisation, registration, translation or other services may incur additional charges payable by the Plan Holder.
If the Plan Holder declines the Will, no cash alternative will be provided.
Where legally permissible, if the Plan is cancelled within the first five years, Elysium may deduct the applicable cost of the Will from any refund due.
Where included within the applicable Privilege Collection:
Full-paying Plans
A donation of up to €40 may be made to a charity selected from Elysium’s approved charity list.
Eligible monthly Plans up to 60 months
A donation of up to €20 may be made.
Donations will normally be made after the applicable Consideration Period and subject to the Plan remaining active.
Where included within the applicable Privilege Collection, Elysium will arrange tree planting through its environmental partner.
Tree planting may take place after the applicable Consideration Period and establishment period.
If the Plan is cancelled before the planting instruction is issued, Elysium may cancel the planting.
Eligible full-paying Plans may also receive anniversary tree planting where specified.
Eligible new full-paying Plan Holders transferring from another funeral-plan provider may qualify for reimbursement of a cancellation fee charged by the previous provider.
Elysium may require:
Elysium will pay the lower of the verified cancellation fee or the maximum amount specified in the applicable Transfer-In terms.
Eligible Plans may participate in Elysium’s annual 12 Draws of Good Luck.
Full-paying Plans will normally be entered into the draw applicable to the month in which the Plan was created.
Eligible monthly Plans will normally be entered after the Plan has been fully paid.
A Plan must be up to date with payments to remain eligible.
Elysium Assist and Non-Resident Plans are not eligible.
A Plan may remain eligible for future draws until it:
Any prize or benefit is subject to the promotional terms applicable to the relevant draw.
A Plan may, subject to Elysium approval and applicable law, be transferred after the qualifying period specified in the Plan Documentation.
For Plans requiring five years before transfer:

Requests to change a Beneficiary must be made in writing to:
Plans may be paid:
The minimum deposit for monthly Plans is €500, unless otherwise stated in the individual Plan Documentation.
A higher deposit may be requested to reduce monthly payments.
Payment methods may vary according to the country in which the Plan is purchased.
If a monthly payment is missed, Elysium will notify the Plan Holder and may attempt to collect the payment again.
If payment remains outstanding, Elysium may request an alternative payment method.
Where a Plan becomes materially overdue, Elysium may suspend the Plan in accordance with the Plan Documentation and applicable law.
If the Plan is suspended and the Plan Holder dies during the suspension period, Elysium’s obligations will be determined by the Plan Documentation, outstanding balance and applicable law.
If a monthly Plan has an outstanding balance when it is called upon, the outstanding contractual balance may need to be paid before the full funeral provision can be provided.
The Next of Kin or authorised representative will be advised of the outstanding amount.
Where the outstanding balance is not paid, Elysium’s obligations will be determined by the applicable Plan terms and law.

To enable us to identify the relevant Plan and process the request, the cancellation request must include the following information:
Refunds will be made to the original payment method, subject to applicable law.
Elysium will not, under any circumstances, refund to a third party account.

To enable us to identify the relevant Plan and process the request, the cancellation request must include the following information:
Full name;
Address;
Date of birth; and
Plan Number.
Once a valid cancellation request has been received, the refund will be processed within 5 working days. A cancellation fee of €495 per cancelled Plan will apply.
Where the Plan Holder(s) have received a refund under the Elysium ‘Transfer-In’ scheme, any amount previously refunded under that scheme will also be deducted from the amount payable upon cancellation.
We reserve the right to offset any amount due against an associated Plan that is in arrears at the time the refund is processed.
Refunds will be made to the original payment method, subject to applicable law.
Elysium will not, under any circumstances, refund to a third party account.
Nothing in these Terms is intended to remove or restrict any statutory consumer right.
Elysium processes personal information in accordance with the EU General Data Protection Regulation and applicable national data-protection legislation.
Information may be processed for the purpose of:
Information may be shared where necessary with appointed Funeral Directors, funeral facilities, crematoria, cemeteries, Celebrants, Will writers, legal professionals, payment providers and other authorised service providers.
Further information is contained within the Elysium Privacy Policy.
Funeral, burial, cremation and repatriation arrangements are subject to the law and operational requirements of the country where the relevant service takes place.
These may include requirements imposed by:
Where a service cannot reasonably be provided exactly as described because of legal, regulatory or operational requirements, Elysium will seek to provide a reasonable alternative within the scope and value of the Plan, where permitted by law.
Elysium will use reasonable care and skill in arranging the services included within a Plan.
Elysium will not be responsible for delay or inability to provide a service where caused by circumstances beyond our reasonable control, including:
Where this occurs, Elysium will seek to provide an appropriate alternative where reasonably possible.
Nothing in these Terms is intended to exclude or restrict mandatory consumer rights applicable in Spain, Portugal, Cyprus, the European Union or elsewhere.
Where applicable law provides rights greater than those stated in these Terms, those rights will apply.
Mandatory legal requirements will prevail over any conflicting provision of these Terms.

Please provide:
We aim to acknowledge complaints within seven days and will provide an anticipated timescale for resolution or further communication.
Where appropriate, Elysium will provide information regarding the relevant consumer or data-protection authority.
Elysium will comply with the mandatory laws and consumer-protection requirements applicable to the Plan and the country concerned.
The applicable contractual law and jurisdiction will be identified in the individual Plan Documentation where required.
Nothing in these Terms prevents a consumer from exercising mandatory rights available under the law applicable to them.
Elysium may update these Terms where reasonably necessary to reflect changes to:
Changes will not retrospectively remove contractual rights already acquired by a Plan Holder where prohibited by law.
The version applicable to an individual Plan will normally be the version supplied when the Plan was created, subject to mandatory legal requirements.
The following documents should be read together:
Where there is a conflict, mandatory law will prevail.
Where the individual Plan Documentation contains specific terms relating to the Plan purchased, those specific terms will apply to that provision.
Elysium will use reasonable care and skill in arranging the services included within each Plan.
No verbal representation will alter these contractual terms unless confirmed in writing by an authorised representative of Elysium.
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
A failure by Elysium to enforce a provision immediately does not constitute a waiver of that provision.
The Plan Holder should retain these Terms together with their individual Plan Documentation and other important documents.
