We are confident that you will be happy with whichever Elysium Funeral Plan you choose. We aim to provide a comprehensive and transparent funeral planning service across Spain, Portugal and Cyprus.

However, if you decide that your chosen plan is not right for you, Elysium Funeral Plans provides a 21-Day Consideration Period during which you may cancel your plan and receive a full refund, subject to the terms below.

CANCELLING WITHIN THE 21-DAY CONSIDERATION PERIOD

If you wish to cancel your Elysium Funeral Plan within the 21-Day Consideration Period, cancellation must be made in writing using one of the following methods:

• Your full name
• Address
• Date of birth
• Elysium Plan Number
• Confirmation that you wish to cancel the plan

You may, if you wish, tell us why you have decided to cancel. This information is entirely optional but may help us improve our services.

REFUND

Where cancellation is received within the 21-Day Consideration Period, Elysium Funeral Plans will process a full refund within 72 hours of receiving and verifying the cancellation request.

The refund will be made using the same payment method originally used to purchase the plan.

Under no circumstances will a refund be:

• Paid into a third-party bank account; or
• Paid to a third-party credit or debit card.

Please note that the time taken for the funds to appear in your account may depend upon your bank or payment provider.

WHEN DOES THE 21-DAY PERIOD START?

The 21-Day Consideration Period begins on the date the Elysium Funeral Plan is created, with that date counted as Day 1.

This 21-Day Consideration Period applies to plans purchased in Spain, Portugal and Cyprus, subject always to any mandatory consumer rights that may apply under the laws and regulations of the country in which the plan is purchased.

AFTER THE 21-DAY CONSIDERATION PERIOD

After the Elysium 21-Day Consideration Period has expired, voluntary cancellation is not normally permitted, except where cancellation, termination or a refund is required or permitted under the applicable law, the specific terms of the plan, or another contractual provision.

Any applicable statutory consumer rights remain unaffected.

STATUTORY CONSUMER RIGHTS

Elysium Funeral Plans SL operates across Spain, Portugal and Cyprus and recognises that consumers may have different statutory rights depending upon the country in which the contract is entered into and the circumstances of the purchase.

Nothing in these Terms & Conditions is intended to remove, restrict or exclude any consumer right that cannot legally be excluded or restricted under the applicable law.

Where a statutory withdrawal, cancellation, refund or other consumer right applies, that right will take precedence over any conflicting provision of these Terms & Conditions.

TELEPHONE CANCELLATIONS

Under no circumstances will telephone instructions alone be accepted as a cancellation of an Elysium Funeral Plan.

This is to protect both the Plan Holder and Elysium Funeral Plans and to ensure that there is a clear written record of the cancellation request.

Any cancellation must therefore be submitted in writing by email or recorded post as detailed above.

IMPORTANT

The 21-Day Consideration Period is an Elysium Funeral Plans contractual benefit and is provided in addition to any mandatory consumer protection rights applicable in Spain, Portugal or Cyprus.
